    Amends the Code of Civil Procedure. Grants quick-take powers to Kankakee County and Sangamon County for the acquisition of the specified property for road construction and maintenance.

1     AN ACT concerning civil procedure.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Code of Civil Procedure is amended by adding
5 Sections 7-103.113 and 7-103.114 as follows:
 
6     (735 ILCS 5/7-103.113 new)
7     Sec. 7-103.113. Quick-take; Kankakee County. Quick-take
8 proceedings under Section 7-103 may be used for a period of 12
9 months from the effective date of this amendatory Act of the
10 93rd General Assembly by Kankakee County, for the purpose of
11 road construction and maintenance, for the acquisition of
12 property legally described as:
 
13     Tract #1:
14     A tract of land lying in Northwest Quarter of Section
15     Twenty-One (21), Township thirty-one North (T31N), Range
16     Thirteen East (R13E) of the Third Principle Meridian (3rd
17     P.M.). Said tract being the North Ninety feet (90') of the
18     Northeast Quarter (NE 1/4) of the Northwest Quarter (NW
19     1/4) of said Section Twenty One (21) (does not constitute a
20     homestead).
 
21     Tract #2:
22     A tract of land lying the Southeast Quarter (SE 1/4) of
23     Section Sixteen (16), Township thirty-one North (T31N),
24     Range Thirteen East (R13E) of the Third Principle Meridian
25     (3rd P.M.). Said tract being described as follows:
26     Commencing at a point on the south line of the Southeast
27     Quarter (SE 1/4) of said Section Sixteen (16), five hundred
28     forty four and five tenth feet (544.5') west of the
29     Southeast Corner (SE) of the Southeast Quarter (SE 1/4) of
30     said Section Sixteen (16), said point to be known as the

1     point of beginning; thence west along said south line of
2     said Section Sixteen (16) at a bearing of S 89° 07' 01" W a
3     distance of two thousand one hundred thirteen and five
4     tenths feet (2113.5') to the Southwest Corner (SW) of the
5     Southeast Quarter (SE 1/4) of said Section Sixteen (16);
6     thence northeasterly a distance of two thousand one hundred
7     thirteen and seventy two hundredths feet (2113.72') at a
8     bearing angle of N 88° 08' 49" E to a point, thence
9     southerly along a straight line a distance of thirty five
10     and seventy eight hundredths feet plus or minus (35.78'
11     +/-) to the point of beginning (does not constitute a
12     homestead).
 
13     Tract #3:
14     A tract of land lying in the Northeast Quarter (NE 1/4) of
15     Section Twenty-One (21), Township thirty-one North (T31N),
16     Range Thirteen East (R13E) of the Third Principle Meridian
17     (3rd P.M.). Said tract being described as follows:
18     Commencing at a point on the West Line of the Northeast
19     Quarter (NE 1/4) of said Section Twenty One (21), Ninety
20     feet (90') South of the Northwest Corner (NW) of the
21     Northeast Quarter (NE 1/4) of said Section Twenty One (21),
22     said point to be known as the point of beginning; thence
23     North along the West Line of the Northeast Quarter (NE 1/4)
24     of said Section Twenty One (21) to the Northwest Corner
25     (NW) of the Northeast Quarter (NE 1/4) of said Section
26     Twenty One (21); thence East along the North Line of said
27     Section Twenty One (21) to the Northeast Corner (NE) of the
28     Northeast Quarter (NE 1/4) of said Section Twenty One (21);
29     thence South along the East Line of said Section Twenty One
30     (21) forty five feet (45') to a point; thence Westerly
31     along a straight line a distance of two thousand six

6     (3rd P.M.). Said tract of land being the North ninety feet
7     (90') of the Northwest Quarter (NW 1/4) of the Northwest
8     Quarter (NW 1/4) of said Section Twenty (20), containing
9     2.781 acres more or less.
 
10     Tract #5:
11     A tract of land lying in the Southeast Quarter (SE 1/4) of
12     Section Sixteen (16), Township Thirty-One North (T31N),
13     Range Thirteen East (R13E) of the Third Principle Meridian
14     (3rd P.M.). Said tract being described as follows:
15     Commencing at a point on the East line of the Southeast
16     Quarter (SE 1/4) of said Section Sixteen (16) forty five
17     feet (45') north of the Southeast Corner (SE) of the said
18     Section Sixteen (16), said point to be known as the point
19     of beginning thence south a distance of forty five feet
20     (45') at a bearing of S 1° 05' 47" E along the east line of
21     the Southeast Quarter (SE 1/4) of said Section Sixteen (16)
22     to the Southeast Corner (SE) of said Section Sixteen (16);
23     thence westerly at a bearing of s 89° 07' 01' W along the
24     south line of the Southeast Quarter (SE 1/4) of said
25     Section Sixteen (16) a distance of five hundred forty four
26     and five tenths feet (544.5') to a point; thence northerly
27     at a bearing of N 1° 05' 47" W a distance of thirty five and
28     seventy eight hundredths feet (35.78') to a point; thence
29     easterly at a bearing of N 88° 08' 49" E a distance of five
30     hundred forty four and forty-nine hundredths feet,
31     (544.49') to the point of beginning, excepting therefrom
32     any portion which has previously been dedicated for public

15     of said Section 6, a distance of 326.11 feet to the point
16     of beginning; thence continuing South 0 degrees 44 minutes
17     49 seconds East, 359.27 feet; thence North 86 degrees 59
18     minutes 03 seconds West, 35.08 feet; thence North 0 degrees
19     44 minutes 49 seconds West, 359.27 feet; thence South 86
20     degrees 59 minutes 03 seconds East, 35.08 feet to the point
21     of beginning.
 
22     All of the above excludes that portion now in use as a
