SYNOPSIS AS INTRODUCED:

Amends the School Code. Provides that beginning no later than January 1, 2005, each school board must prohibit soft drinks and candy from being dispensed to students by school vending machines. Effective immediately.

AN ACT concerning schools.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The School Code is amended by adding Sections 10-20.39 and 34-18.30 as follows:

Sec. 10-20.39. Vending machines; soft drinks and candy prohibited. Beginning no later than January 1, 2005, each school board must prohibit soft drinks and candy from being dispensed to students by school vending machines.

Sec. 34-18.30. Vending machines; soft drinks and candy prohibited. Beginning no later than January 1, 2005, the board must prohibit soft drinks and candy from being dispensed to students by school vending machines.

Section 90. The State Mandates Act is amended by adding Section 8.28 as follows:

Sec. 8.28. Exempt mandate. Notwithstanding Sections 6 and 8 of this Act, no reimbursement by the State is required for the implementation of any mandate created by this amendatory Act of the 93rd General Assembly.

Section 99. Effective date. This Act takes effect upon becoming law.
