SYNOPSIS AS INTRODUCED:

    Amends the State Finance Act, the Illinois Income Tax Act, the Illinois Vehicle Code, and the Illinois Identification Card Act. Provides that an applicant for a driver's license or instruction permit, a commercial driver's license or instruction permit, or a State identification card shall be asked if he or she wants to donate $1 to the Juvenile Diabetes Research and Nutritional Health Trust Fund, in addition to any other applicable fees. Creates the Juvenile Diabetes Research and Nutritional Health Trust Fund as a special fund in the State treasury. Provides that all moneys in the Juvenile Diabetes Research and Nutritional Health Trust Fund shall be used by the Department of Public Health for juvenile diabetes research, nutritional health programs, education, and public awareness and to reimburse the Secretary of State for administrative costs relating to the $1 donations. Creates the Juvenile Diabetes Research and Nutritional Health Fund checkoff. Provides that the Department of Revenue shall print on its standard individual income tax form a provision indicating that if the taxpayer wishes to contribute to the Juvenile Diabetes Research and Nutritional Health Fund he or she may do so by stating the amount of the contribution on the return and tha the contribution will reduce the taxpayer's refund or increase the amount of payment to accompany the return.

1     AN ACT in relation to juvenile diabetes research and
2 nutritional health.
 
3     Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
 
5     Section 5. The State Finance Act is amended by adding
6 Section 5.625 as follows:
 
7     (30 ILCS 105/5.625 new)
8     Sec. 5.625. The Juvenile Diabetes Research and Nutritional
9 Health Trust Fund.
 
10     Section 10. The Illinois Identification Card Act is amended
11 by changing Section 5 as follows:
 
12     (15 ILCS 335/5)  (from Ch. 124, par. 25)
13     Sec. 5. Applications.
14     (a) Any natural person who is a resident of the State of
15 Illinois, may file an application for an identification card or
16 for the renewal thereof, in a manner prescribed by the
17 Secretary. Each original application shall be completed by the
18 applicant in full and shall set forth the name, address and zip
19 code, social security number, birth date, sex and a brief
20 description of the applicant. The applicant shall be
21 photographed and he shall also submit any other information as
22 the Secretary may deem necessary or such documentation as the
23 Secretary may require to determine the identity of the
24 applicant. An applicant for a disabled persons card must also
25 submit with each original or renewal application, on forms
26 prescribed by the Secretary, such documentation as the
27 Secretary may require, establishing that the applicant is a
28 "disabled person" as defined in Section 4A of this Act, and
29 setting forth the applicant's type and class of disability as
30 set forth in Section 4A of this Act.

1     (b) In addition to the fees collected under Section 12 of
2 this Act, the Secretary of State shall ask each person applying
3 for or renewing a State identification card whether the person
4 wishes to make a $1 voluntary contribution to the Juvenile
5 Diabetes Research and Nutritional Health Trust Fund
6 established under Section 6-106 of the Illinois Vehicle Code.
7 All donations collected under this subsection (b) shall be
8 deposited into the Juvenile Diabetes Research and Nutritional
9 Health Trust Fund.

11     Section 15. The Illinois Income Tax Act is amended by
12 adding Section 507BB as follows:
 
13     (35 ILCS 5/507BB new)
14     Sec. 507BB. The Juvenile Diabetes Research and Nutritional
15 Health Trust Fund checkoff. Beginning with taxable years ending
16 on or after December 31, 2004, the Department shall print on
17 its standard individual income tax form a provision indicating
18 that if the taxpayer wishes to contribute to the Juvenile
19 Diabetes Research and Nutritional Health Trust Fund, as
20 authorized by this amendatory Act of the 93rd General Assembly,
21 he or she may do so by stating the amount of the contribution
22 (not less than $1) on the return and that the contribution will
23 reduce the taxpayer's refund or increase the amount of payment
24 to accompany the return. Failure to remit any amount of
25 increased payment shall reduce the contribution accordingly.
26 This Section shall not apply to any amended return.

28     Section 20. The Illinois Vehicle Code is amended by
29 changing Sections 6-106 and 6-510 as follows:

31     Sec. 6-106. Application for license or instruction permit.
32     (a) Every application for any permit or license authorized

1 to be issued under this Act shall be made upon a form furnished
2 by the Secretary of State. Every application shall be
3 accompanied by the proper fee and payment of such fee shall
4 entitle the applicant to not more than 3 attempts to pass the
5 examination within a period of 1 year after the date of
6 application.
7     (b) Every application shall state the name, social security
8 number, zip code, date of birth, sex, and residence address of
9 the applicant; briefly describe the applicant; state whether
10 the applicant has theretofore been licensed as a driver, and,
11 if so, when and by what state or country, and whether any such
12 license has ever been cancelled, suspended, revoked or refused,
13 and, if so, the date and reason for such cancellation,
14 suspension, revocation or refusal; shall include an
15 affirmation by the applicant that all information set forth is
16 true and correct; and shall bear the applicant's signature. The
17 application form may also require the statement of such
18 additional relevant information as the Secretary of State shall
19 deem necessary to determine the applicant's competency and
20 eligibility. The Secretary of State may in his discretion
21 substitute a federal tax number in lieu of a social security
22 number, or he may instead assign an additional distinctive
23 number in lieu thereof, where an applicant is prohibited by
24 bona fide religious convictions from applying or is exempt from
25 applying for a social security number. The Secretary of State
26 shall, however, determine which religious orders or sects have
27 such bona fide religious convictions. The Secretary of State
28 may, in his discretion, by rule or regulation, provide that an
29 application for a drivers license or permit may include a
30 suitable photograph of the applicant in the form prescribed by
31 the Secretary, and he may further provide that each drivers
32 license shall include a photograph of the driver. The Secretary
33 of State may utilize a photograph process or system most
34 suitable to deter alteration or improper reproduction of a
35 drivers license and to prevent substitution of another photo
36 thereon.

1     (c) The application form shall include a notice to the
2 applicant of the registration obligations of sex offenders
3 under the Sex Offender Registration Act. The notice shall be
4 provided in a form and manner prescribed by the Secretary of
5 State. For purposes of this subsection (c), "sex offender" has
6 the meaning ascribed to it in Section 2 of the Sex Offender
7 Registration Act.
8     (d) Any male United States citizen or immigrant who applies
9 for any permit or license authorized to be issued under this
10 Act or for a renewal of any permit or license, and who is at
11 least 18 years of age but less than 26 years of age, must be
12 registered in compliance with the requirements of the federal
13 Military Selective Service Act. The Secretary of State must
14 forward in an electronic format the necessary personal
15 information regarding the applicants identified in this
16 subsection (d) to the Selective Service System. The applicant's
17 signature on the application serves as an indication that the
18 applicant either has already registered with the Selective
19 Service System or that he is authorizing the Secretary to
20 forward to the Selective Service System the necessary
21 information for registration. The Secretary must notify the
22 applicant at the time of application that his signature
23 constitutes consent to registration with the Selective Service
24 System, if he is not already registered.
25     (e) In addition to the fees collected under Section 6-118
26 of this Act, the Secretary of State shall ask each person
27 applying for or renewing a license or instruction permit
28 whether the person wishes to make a $1 voluntary contribution
29 to the Juvenile Diabetes Research and Nutritional Health Trust
30 Fund established under this Section. All donations collected
31 under this subsection (e) shall be deposited into the Juvenile
32 Diabetes Research and Nutritional Health Trust Fund.
33     (f) The Juvenile Diabetes Research and Nutritional Health
34 Trust Fund is created as a special fund in the State treasury.
35 All moneys in the Juvenile Diabetes Research and Nutritional
36 Health Trust Fund shall, subject to appropriation by the

1 General Assembly and approval by the Secretary of State, be
2 used by the Department of Public Health for the following
3 purposes:
4         (1) Development and implementation of a campaign that
5     explains and promotes the Juvenile Diabetes Research and
6     Nutritional Health Trust Fund;
7         (2) Development and implementation of juvenile
8     diabetes research programs and related nutritional health
9     programs;
10         (3) Development and implementation of local and
11     statewide public education programs about juvenile
12     diabetes and nutritional health;
13         (4) Development and distribution of materials raising
14     awareness of juvenile diabetes and nutritional health;
15         (5) Development and implementation of local and
16     statewide juvenile diabetes awareness programs in
17     secondary schools;
18         (6) Development and implementation of a nutritional
19     awareness hotline;
20         (7) Reimbursement of the Secretary of State for
21     administrative costs incurred in the performance of duties
22     under subsection (e) of this Section, subsection (b) of
23     Section 6-510 of this Code, and subsection (b) of Section 5
24     of the Illinois Identification Card Act.
25     (g) The Director of Public Health shall make the materials
26 developed under subsection (f) of this Section available to
27 other State agencies.

30     Sec. 6-510. Application for Commercial Driver's License
31 (CDL).
32     (a) The application for a CDL or commercial driver
33 instruction permit, must include, but not necessarily be
34 limited to, the following:
35         (1) the full name and current Illinois domiciliary

1     address (unless the application is for a Non-resident CDL)
2     of the applicant;
3         (2) a physical description of the applicant including
4     sex, height, weight, color of eyes and hair color;
5         (3) date of birth;
6         (4) the applicant's social security number or other
7     identifying number acceptable to the Secretary of State;
8         (5) the applicant's signature;
9         (6) certifications required by 49 C.F.R. Part 383.71;
10     and
11         (7) any other information required by the Secretary of
12     State.
13     (b) In addition to the fees collected under Section 6-118
14 of this Act, the Secretary of State shall ask each person
15 applying for or renewing a CDL or commercial instruction permit
16 whether the person wishes to make a $1 voluntary contribution
17 to the Juvenile Diabetes Research and Nutritional Health Trust
18 Fund established under Section 6-106 of this Code. All
19 donations collected under this subsection (b) shall be
20 deposited into the Juvenile Diabetes Research and Nutritional
21 Health Trust Fund.
