 1        AN ACT in relation ot highways.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The Toll Highway Act is amended  by  changing
 5    Section 3 as follows:

 6        (605 ILCS 10/3) (from Ch. 121, par. 100-3)
 7        Sec.  3. There is hereby created an Authority to be known
 8    as The Illinois State Toll Highway Authority, which is hereby
 9    constituted an instrumentality and an  administrative  agency
10    of the State of Illinois. The said Authority shall consist of
11    11   directors;   the  Governor  and  the  Secretary  of  the
12    Department of Transportation, ex  officio,  and  9  directors
13    appointed  by the Governor with the advice and consent of the
14    Senate, of whom one shall be from Will County and 8 from  the
15    State at large, which said directors and their successors are
16    hereby  authorized  to  carry out the provisions of this Act,
17    and to  exercise  the  powers  herein  conferred.  Of  the  9
18    directors  appointed by the Governor, no more than 5 shall be
19    members of the  same  political  party.  Vacancies  shall  be
20    filled  for the unexpired term in the same manner as original
21    appointments. All appointments shall be in writing and  filed
22    with  the  Secretary  of  State as a public record. It is the
23    intention of this section that  the  Governor's  appointments
24    shall  be  made  with  due  consideration  to the location of
25    proposed toll  highway  routes  so  that  maximum  geographic
26    representation  from  the  areas  served by said toll highway
27    routes may be accomplished insofar as practicable.  The  said
28    Authority  shall have the power to contract and be contracted
29    with, to acquire, hold and convey personal and real  property
30    or  any  interest therein including rights of way, franchises
31    and easements; to have and use a common seal,  and  to  alter

 1    the same at will; to make and establish resolutions, by-laws,
 2    rules, rates and regulations, and to alter or repeal the same
 3    as  the  Authority shall deem necessary and expedient for the
 4    construction,   operation,   relocation,    regulation    and
 5    maintenance  of  a system of toll highways within and through
 6    the State of Illinois.
 7        Appointment of the additional directors provided  for  by
 8    this  amendatory  Act  of  1980  shall be made within 30 days
 9    after the effective date of this amendatory Act of 1980.
