 1        AN ACT in relation to vehicles.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The  Illinois  Vehicle  Code  is  amended by
 5    changing Section 6-117 as follows:

 6        (625 ILCS 5/6-117) (from Ch. 95 1/2, par. 6-117)
 7        Sec. 6-117.  Records to  be  kept  by  the  Secretary  of
 8    State.
 9        (a)  The  Secretary of State shall file every application
10    for a license or permit  accepted  under  this  Chapter,  and
11    shall   maintain   suitable  indexes  of  those  applications
12    thereof. The records of the Secretary of State shall indicate
13    the action taken with respect to such applications.
14        (b)  The Secretary of State  shall  maintain  appropriate
15    records  of  all  licenses  and  permits  refused, cancelled,
16    revoked or suspended and of the revocation and suspension  of
17    driving   privileges  of  persons  not  licensed  under  this
18    Chapter, and such records shall note  the  reasons  for  such
19    action.
20        (c)  The  Secretary  of  State shall maintain appropriate
21    records of convictions reported under this  Chapter.  Records
22    of  conviction  may  be  maintained in a computer processible
23    medium.
24        (d)  The Secretary of State may also maintain appropriate
25    records of any accident reports received.
26        (e)  The  Secretary  of   State   shall   also   maintain
27    appropriate  records  of  any  disposition  of supervision or
28    records relative to a driver's referral to a driver  remedial
29    or  rehabilitative  program,  as required by the Secretary of
30    State or the courts.  Such records shall  only  be  available
31    for  use  by  the  Secretary,  law  enforcement agencies, the

 1    courts, and the affected driver or, upon proper verification,
 2    such affected driver's attorney.
 3        (f)  The  Secretary  of  State  shall  also  maintain  or
 4    contract to maintain appropriate records of  all  photographs
 5    and  signatures  obtained  in  the  process  of  issuing  any
 6    driver's license, permit, or identification card.  The record
 7    shall  be  confidential  and shall not be disclosed except to
 8    those entities listed under Section 6-110.1 of this Code.
