 1        AN ACT concerning contact lenses.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The Mail Order Contact Lens Act is amended by
 5    changing Section 30 as follows:

 6        (225 ILCS 83/30)
 7        Sec. 30.  Violation; civil penalty.
 8        (a)  Any person who dispenses,  offers  to  dispense,  or
 9    attempts  to dispense contact lenses in violation of this Act
10    or the its rules adopted under this Act shall, in addition to
11    any other penalty provided by law, pay a civil penalty to the
12    Department in an amount not to exceed $5,000 for each offense
13    as determined by the Department. The civil penalty  shall  be
14    assessed  by  the  Department  after  a  hearing  is  held in
15    accordance with the provisions  set  forth  in  the  Illinois
16    Administrative Procedure Act.
17        (b)  The  Department  may  investigate  all violations of
18    this Act.
19        (c)  The civil penalty shall be paid within 60 days after
20    the effective date of the order imposing the  civil  penalty.
21    The  order  constitutes  a  judgment  and  may  be  filed and
22    execution had thereon in the same manner as any judgment from
23    any court of record.
