 1        AN ACT in relation to environmental protection.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.   The Environmental Protection Act is amended
 5    by adding Section 22.49 as follows:

 6        (415 ILCS 5/22.49 new)
 7        Sec.  22.49.  Municipal  waste  transportation;   vehicle
 8    requirements.
 9        (a)  Beginning  January  1, 2004, no person may transport
10    municipal  waste  more  than  50  miles  from  the  point  of
11    generation or transfer to a sanitary landfill or  incinerator
12    in  Illinois,  unless  the municipal waste is contained in an
13    enclosed transportation vehicle or compartment.
14        (b)  Beginning January 1,  2004,  no  person  may  accept
15    municipal  waste  for  disposal  in  a  sanitary  landfill or
16    incinerator if the municipal waste has been transported  more
17    than  50  miles  from  the  point  of generation or transfer,
18    unless the  municipal  waste  is  contained  in  an  enclosed
19    transportation vehicle or compartment.

20        Section  99.  Effective date.  This Act takes effect upon
21    becoming law.
