 1        AN ACT in relation to criminal law.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The Code of Criminal  Procedure  of  1963  is
 5    amended by changing Section 115-19 as follows:

 6        (725 ILCS 5/115-19)
 7        Sec. 115-19.  Polygraph.
 8        (a)  In  the  course  of a criminal trial the court shall
 9    not require, request, or suggest that the defendant submit to
10    a polygraphic detection deception test, commonly known  as  a
11    lie  detector  test,  to  questioning  under  the  effect  of
12    thiopental  sodium,  or  to  any other test or questioning by
13    means of a mechanical device or chemical substance.
14        (b)  The  results  of   a   polygraph   examination   are
15    inadmissable  as  evidence  in a capital case both during the
16    trial of the case and during the separate sentencing hearing.
