 1        AN ACT in relation to criminal law.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The Criminal  Code  of  1961  is  amended  by
 5    adding Section 5-6 as follows:

 6        (720 ILCS 5/5-6 new)
 7        Sec.  5-6.  Victims  of  domestic violence. A parent of a
 8    child under 18 years of age is not criminally liable for  the
 9    death of that child caused by a spouse, ex-spouse, person who
10    is  the  other parent of the child or alleged to be the other
11    parent of the child, person  who  has  or  had  a  dating  or
12    engagement  relationship,  or  paramour of the parent who has
13    engaged in a known pattern of domestic violence  against  the
14    parent  or  child  if  the  parent  did not directly cause or
15    participate in the act that resulted  in  the  death  of  the
16    child.  The  parent is not criminally responsible even if the
17    act or acts of domestic violence  are  not  reported  to  the
18    State's  Attorney  or  local  law enforcement agency. In this
19    Section, "domestic violence" has the meaning ascribed  to  it
20    in Section 112A-3 of the Code of Criminal Procedure of 1963.
