 1        AN ACT in relation to criminal law.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5. The Code of  Criminal  Procedure  of  1963  is
 5    amended by adding Section 107-17 as follows:

 6        (725 ILCS 5/107-17 new)
 7        Sec.    107-17.    Lineup    and    photographic   spread
 8    identification. Any statement made by  the  eyewitness  at  a
 9    lineup  or photographic spread in a homicide investigation as
10    to the witness's confidence that the identified person is  or
11    is  not the actual person who committed the homicide shall be
12    recorded in writing and the statement  shall  be  signed  and
13    dated by the eyewitness.
