 1        AN ACT concerning consumer protection.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The  Consumer  Fraud  and Deceptive Business
 5    Practices Act is amended by adding Section 2MM as follows:

 6        (815 ILCS 505/2MM new)
 7        Sec. 2MM.  Utility, telecommunications and cable services
 8    providers; filed rate doctrine.
 9        (a)  Companies  marketing   electricity,   natural   gas,
10    telecommunications,  or  cable  television services to retail
11    customers  are  subject  to  the  provisions  of   this   Act
12    regardless  of  whether  rates  are on file with any federal,
13    State, or local commission.
14        (b)  The filed rate doctrine does not provide  a  defense
15    to any action brought under this Act.

16        Section  99.  Effective date.  This Act takes effect upon
17    becoming law.
