 1        AN ACT concerning higher education.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The University of Illinois Act is amended  by
 5    adding Section 7a-5 as follows:

 6        (110 ILCS 305/7a-5 new)
 7        Sec.   7a-5.  Violation   of   policy  governing  student
 8    conduct; fine.
 9        (a)  If a student has paid a fine to a  municipality  for
10    conduct  involving alcohol that violated an ordinance and the
11    University imposes a  fine  on  that  student  for  the  same
12    conduct  because  the  conduct  violated  a university policy
13    governing student conduct (and if the student  has  submitted
14    proof  to  the University that a fine was imposed by and paid
15    to  the  municipality  for  the  same  conduct),   then   the
16    University  must  credit  the  fine  paid to the municipality
17    against the fine imposed by the University.
18        (b)  If a student has paid a fine to the  University  for
19    conduct  involving  alcohol that violated a university policy
20    governing student conduct and a municipality imposes  a  fine
21    on  that  student  for  the  same conduct because the conduct
22    violated an ordinance (and if the student has submitted proof
23    to the University that a fine was imposed by the municipality
24    for the same conduct), then the University must  pay  to  the
25    municipality on behalf of the student the fine imposed by the
26    municipality  or that part of the fine that equals the amount
27    of the fine imposed by the University, whichever is less.
28        (c)  Nothing in this Section shall prevent the University
29    from  taking  any  other  disciplinary  action  against   the
30    student.

 1        Section  10.  The Southern Illinois University Management
 2    Act is amended by adding Section 8a-5 as follows:

 3        (110 ILCS 520/8a-5 new)
 4        Sec.  8a-5.  Violation  of   policy   governing   student
 5    conduct; fine.
 6        (a)  If  a  student has paid a fine to a municipality for
 7    conduct involving alcohol that violated an ordinance and  the
 8    University  imposes  a  fine  on  that  student  for the same
 9    conduct because the  conduct  violated  a  university  policy
10    governing  student  conduct (and if the student has submitted
11    proof to the University that a fine was imposed by  and  paid
12    to   the   municipality  for  the  same  conduct),  then  the
13    University must credit the  fine  paid  to  the  municipality
14    against the fine imposed by the University.
15        (b)  If  a  student has paid a fine to the University for
16    conduct involving alcohol that violated a  university  policy
17    governing  student  conduct and a municipality imposes a fine
18    on that student for the  same  conduct  because  the  conduct
19    violated an ordinance (and if the student has submitted proof
20    to the University that a fine was imposed by the municipality
21    for  the  same  conduct), then the University must pay to the
22    municipality on behalf of the student the fine imposed by the
23    municipality or that part of the fine that equals the  amount
24    of the fine imposed by the University, whichever is less.
25        (c)  Nothing in this Section shall prevent the University
26    from   taking  any  other  disciplinary  action  against  the
27    student.

28        Section 15.  The Chicago State University Law is  amended
29    by adding Section 5-62 as follows:

 2        (a)  If a student has paid a fine to a  municipality  for
 3    conduct  involving alcohol that violated an ordinance and the
 4    University imposes a  fine  on  that  student  for  the  same
 5    conduct  because  the  conduct  violated  a university policy
 6    governing student conduct (and if the student  has  submitted
 7    proof  to  the University that a fine was imposed by and paid
 8    to  the  municipality  for  the  same  conduct),   then   the
 9    University  must  credit  the  fine  paid to the municipality
10    against the fine imposed by the University.
11        (b)  If a student has paid a fine to the  University  for
12    conduct  involving  alcohol that violated a university policy
13    governing student conduct and a municipality imposes  a  fine
14    on  that  student  for  the  same conduct because the conduct
15    violated an ordinance (and if the student has submitted proof
16    to the University that a fine was imposed by the municipality
17    for the same conduct), then the University must  pay  to  the
18    municipality on behalf of the student the fine imposed by the
19    municipality  or that part of the fine that equals the amount
20    of the fine imposed by the University, whichever is less.
21        (c)  Nothing in this Section shall prevent the University
22    from  taking  any  other  disciplinary  action  against   the
23    student.

24        Section  20.  The  Eastern  Illinois  University  Law  is
25    amended by adding Section 10-62 as follows:

26        (110 ILCS 665/10-62 new)
27        Sec.   10-62.  Violation   of  policy  governing  student
28    conduct; fine.
29        (a)  If a student has paid a fine to a  municipality  for
30    conduct  involving alcohol that violated an ordinance and the
31    University imposes a  fine  on  that  student  for  the  same
32    conduct  because  the  conduct  violated  a university policy

 1    governing student conduct (and if the student  has  submitted
 2    proof  to  the University that a fine was imposed by and paid
 3    to  the  municipality  for  the  same  conduct),   then   the

 6        (b)  If a student has paid a fine to the  University  for
 7    conduct  involving  alcohol that violated a university policy
 8    governing student conduct and a municipality imposes  a  fine

10    violated an ordinance (and if the student has submitted proof
11    to the University that a fine was imposed by the municipality
12    for the same conduct), then the University must  pay  to  the
13    municipality on behalf of the student the fine imposed by the
14    municipality  or that part of the fine that equals the amount
15    of the fine imposed by the University, whichever is less.
16        (c)  Nothing in this Section shall prevent the University
17    from  taking  any  other  disciplinary  action  against   the
18    student.

19        Section   25.  The  Governors  State  University  Law  is
20    amended by adding Section 15-62 as follows:

21        (110 ILCS 670/15-62 new)
22        Sec.  15-62.  Violation  of  policy   governing   student
23    conduct; fine.
24        (a)  If  a  student has paid a fine to a municipality for
25    conduct involving alcohol that violated an ordinance and  the
26    University  imposes  a  fine  on  that  student  for the same
27    conduct because the  conduct  violated  a  university  policy
28    governing  student  conduct (and if the student has submitted
29    proof to the University that a fine was imposed by  and  paid
30    to   the   municipality  for  the  same  conduct),  then  the
31    University must credit the  fine  paid  to  the  municipality
32    against the fine imposed by the University.

 1        (b)  If  a  student has paid a fine to the University for
 2    conduct involving alcohol that violated a  university  policy
 3    governing  student  conduct and a municipality imposes a fine
 4    on that student for the  same  conduct  because  the  conduct

 6    to the University that a fine was imposed by the municipality
 7    for  the  same  conduct), then the University must pay to the
 8    municipality on behalf of the student the fine imposed by the
 9    municipality or that part of the fine that equals the  amount
10    of the fine imposed by the University, whichever is less.
11        (c)  Nothing in this Section shall prevent the University
12    from   taking  any  other  disciplinary  action  against  the
13    student.

14        Section 30.  The Illinois State University Law is amended
15    by adding Section 20-62 as follows:

16        (110 ILCS 675/20-62 new)
17        Sec.  20-62.  Violation  of  policy   governing   student
18    conduct; fine.
19        (a)  If  a  student has paid a fine to a municipality for
20    conduct involving alcohol that violated an ordinance and  the
21    University  imposes  a  fine  on  that  student  for the same
22    conduct because the  conduct  violated  a  university  policy
23    governing  student  conduct (and if the student has submitted
24    proof to the University that a fine was imposed by  and  paid
25    to   the   municipality  for  the  same  conduct),  then  the
26    University must credit the  fine  paid  to  the  municipality
27    against the fine imposed by the University.
28        (b)  If  a  student has paid a fine to the University for
29    conduct involving alcohol that violated a  university  policy
30    governing  student  conduct and a municipality imposes a fine
31    on that student for the  same  conduct  because  the  conduct
32    violated an ordinance (and if the student has submitted proof

 1    to the University that a fine was imposed by the municipality
 2    for  the  same  conduct), then the University must pay to the
 3    municipality on behalf of the student the fine imposed by the
 4    municipality or that part of the fine that equals the  amount
 5    of the fine imposed by the University, whichever is less.
 6        (c)  Nothing in this Section shall prevent the University
 7    from   taking  any  other  disciplinary  action  against  the
 8    student.

 9        Section 35.  The Northeastern Illinois University Law  is
10    amended by adding Section 25-62 as follows:

11        (110 ILCS 680/25-62 new)
12        Sec.   25-62.  Violation   of  policy  governing  student
13    conduct; fine.
14        (a)  If a student has paid a fine to a  municipality  for
15    conduct  involving alcohol that violated an ordinance and the
16    University imposes a  fine  on  that  student  for  the  same
17    conduct  because  the  conduct  violated  a university policy
18    governing student conduct (and if the student  has  submitted
19    proof  to  the University that a fine was imposed by and paid
20    to  the  municipality  for  the  same  conduct),   then   the
21    University  must  credit  the  fine  paid to the municipality
22    against the fine imposed by the University.
23        (b)  If a student has paid a fine to the  University  for
24    conduct  involving  alcohol that violated a university policy
25    governing student conduct and a municipality imposes  a  fine
26    on  that  student  for  the  same conduct because the conduct
27    violated an ordinance (and if the student has submitted proof
28    to the University that a fine was imposed by the municipality
29    for the same conduct), then the University must  pay  to  the
30    municipality on behalf of the student the fine imposed by the
31    municipality  or that part of the fine that equals the amount
32    of the fine imposed by the University, whichever is less.

 1        (c)  Nothing in this Section shall prevent the University
 2    from  taking  any  other  disciplinary  action  against   the
 3    student.

 4        Section  40.  The  Northern  Illinois  University  Law is
 5    amended by adding Section 30-62 as follows:

 6        (110 ILCS 685/30-62 new)
 7        Sec.  30-62.  Violation  of  policy   governing   student
 8    conduct; fine.
 9        (a)  If  a  student has paid a fine to a municipality for
10    conduct involving alcohol that violated an ordinance and  the
11    University  imposes  a  fine  on  that  student  for the same
12    conduct because the  conduct  violated  a  university  policy
13    governing  student  conduct (and if the student has submitted
14    proof to the University that a fine was imposed by  and  paid
15    to   the   municipality  for  the  same  conduct),  then  the
16    University must credit the  fine  paid  to  the  municipality
17    against the fine imposed by the University.
18        (b)  If  a  student has paid a fine to the University for
19    conduct involving alcohol that violated a  university  policy
20    governing  student  conduct and a municipality imposes a fine
21    on that student for the  same  conduct  because  the  conduct
22    violated an ordinance (and if the student has submitted proof
23    to the University that a fine was imposed by the municipality
24    for  the  same  conduct), then the University must pay to the
25    municipality on behalf of the student the fine imposed by the
26    municipality or that part of the fine that equals the  amount
27    of the fine imposed by the University, whichever is less.
28        (c)  Nothing in this Section shall prevent the University
29    from   taking  any  other  disciplinary  action  against  the
30    student.

31        Section  45.  The  Western  Illinois  University  Law  is

 1    amended by adding Section 35-62 as follows:

 2        (110 ILCS 690/35-62 new)
 3        Sec.  35-62.  Violation  of  policy   governing   student
 4    conduct; fine.
 5        (a)  If  a  student has paid a fine to a municipality for
 6    conduct involving alcohol that violated an ordinance and  the
 7    University  imposes  a  fine  on  that  student  for the same
 8    conduct because the  conduct  violated  a  university  policy
 9    governing  student  conduct (and if the student has submitted
10    proof to the University that a fine was imposed by  and  paid
11    to   the   municipality  for  the  same  conduct),  then  the
12    University must credit the  fine  paid  to  the  municipality
13    against the fine imposed by the University.
14        (b)  If  a  student has paid a fine to the University for
15    conduct involving alcohol that violated a  university  policy
16    governing  student  conduct and a municipality imposes a fine
17    on that student for the  same  conduct  because  the  conduct
18    violated an ordinance (and if the student has submitted proof
19    to the University that a fine was imposed by the municipality
20    for  the  same  conduct), then the University must pay to the
