 1        AN ACT concerning surface-mined land.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.   The  Surface-Mined  Land  Conservation  and
 5    Reclamation Act is amended by changing Section 4 as follows:

 6        (225 ILCS 715/4) (from Ch. 96 1/2, par. 4504)
 7        Sec. 4. Necessity of permit. It shall be unlawful for any
 8    operator  to  engage  in  surface mining in an area where the
 9    overburden shall  exceed  10  feet  in  depth  or  where  the
10    operation  will affect more than 2 10 acres during the permit
11    year without first obtaining from the Department a permit  so
12    to do so, in such form as is hereinafter provided.

14        Section  99.  Effective date.  This Act takes effect upon
15    becoming law.
