 1        AN ACT regarding school buses.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5. The School Code is amended by adding  Sections
 5    10-20.37 and 34-18.26 as follows:

 6        (105 ILCS 5/10-20.37 new)
 7        Sec.  10-20.37.  School  bus  idling  policy. Each school
 8    board shall adopt a policy that prohibits a school  bus  that
 9    is  in  operation for the purpose of transporting students to
10    or from school or a school-related function or activity  from
11    running  on  idle  for  more  than  one hour while the bus is
12    parked. If the school bus driver violates this  policy,  then
13    the  board may fine the driver up to $500 per violation. If a
14    private school bus contractor rather than the school district
15    provides the transportation, then the board may also fine the
16    contractor up to $500 per violation by the  bus  driver.  The
17    policy  must provide for exceptions to the idling prohibition
18    for zero emission school buses and emergency situations.
