 1        AN ACT concerning the Department of Agriculture.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The  Department  of  Agriculture  Law of the
 5    Civil Administrative Code of Illinois is  amended  by  adding
 6    Section 205-500 as follows:

 7        (20 ILCS 205/205-500 new)
 8        Sec.  205-500. Lease agreements. The Department may lease
 9    any property  or  facility  under  the  jurisdiction  of  the
10    Department  for  a  period  not  to exceed 10 years. All such
11    leases in excess of 5  years  shall  be  subject  to  written
12    approval  by the Governor. All leases for concessions entered
13    into after the effective date of this amendatory Act  of  the
14    93rd  General  Assembly  shall  contain  a  provision for the
15    Department to receive a percentage of the  revenue  generated
16    by the concessions.
17        The Department may assess appropriate and reasonable fees
18    for   the   lease   of   property  or  facilities  under  the
19    jurisdiction of the Department. The Department may  regulate,
20    by rule, the fees to be charged. The Department shall deposit
21    the  revenues  collected into the appropriate fund supporting
22    the property or facility for use by the Department.

23        Section 99.  Effective date.  This Act takes effect  upon
24    becoming law.
