 1        AN ACT concerning telecommunications.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The  Public  Utilities  Act  is  amended  by
 5    changing Section 13-301.2 as follows:

 7        (Section scheduled to be repealed on July 1, 2005)
 8        Sec.  13-301.2.  Program  to  Foster  Elimination  of the
 9    Digital Divide. The Commission shall  require  by  rule  that
10    each  telecommunications  carrier  providing  local  exchange
11    telecommunications service notify its end-user customers that
12    if  the  customer wishes to participate in the funding of the
13    Program to Foster Elimination of the Digital Divide he or she
14    may do so by electing to contribute, on a  monthly  basis,  a
15    fixed  amount that will be included in the customer's monthly
16    bill.  To the extent that its end-user   customers  subscribe
17    to   such   service,  telecommunications  carriers  providing
18    cellular radio service are exempted from the requirements  of
19    this  Section.    The  customer may cease contributing at any
20    time upon providing notice to the telecommunications carrier.
21    The notice shall state that any contribution  made  will  not
22    reduce  the  customer's bill for telecommunications services.
23    Failure to remit the amount of increased payment will  reduce
24    the  contribution  accordingly.  The Commission shall specify
25    the monthly fixed amount or amounts that customers wishing to
26    contribute  to  the  funding  of  the   Program   to   Foster
27    Elimination  of  the Digital Divide may choose from in making
28    their contributions.  A telecommunications carrier subject to
29    this obligation shall remit the amounts  contributed  by  its
30    customers to the Department of Commerce and Community Affairs
31    for  deposit  in  the  Digital Divide Elimination Fund at the
