 1        AN ACT concerning speech-language pathology.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.   The  School  Code  is  amended  by changing
 5    Section 14-1.09b as follows:

 6        (105 ILCS 5/14-1.09b)
 7        Sec. 14-1.09b.  Speech-language pathologist.
 8        (a)  For purposes of  supervision  of  a  speech-language
 9    pathology  assistant,  "speech-language  pathologist" means a
10    person who has received a license pursuant  to  the  Illinois
11    Speech-Language  Pathology  and  Audiology  Practice  Act  to
12    engage in the practice of speech-language pathology.
13        (b)  The  School  Service  Personnel  Certificate  with a
14    speech-language endorsement shall  be  issued  under  Section
15    21-25 of this Code to a speech-language pathologist who meets
16    all of the following requirements:
17             (1)  Holds    (A)    a    regular   license   as   a
18        speech-language  pathologist  pursuant  to  the  Illinois
19        Speech-Language Pathology and Audiology Practice Act, (B)
20        a  current  Certificate   of   Clinical   Competence   in
21        speech-language     pathology     from    the    American
22        Speech-Language-Hearing Association and a regular license
23        in  speech-language  pathology  from  another  state   or
24        territory or the District of Columbia and has applied for
25        a   regular  license  as  a  speech-language  pathologist
26        pursuant to the Illinois  Speech-Language  Pathology  and
27        Audiology  Practice  Act,  or  (C)  a  temporary  license
28        pursuant  to  the  Illinois Speech-Language Pathology and
29        Audiology Practice Act  and  has  completed  an  approved
30        program.
31             (2) Holds a master's or doctoral degree with a major

 1        emphasis in speech-language pathology from an institution
 2        whose  course  of  study  was  approved  or  program  was
 3        accredited  by  the  Council on Academic Accreditation in
 4        Audiology and Speech-Language Pathology of  the  American
 5        Speech-Language-Hearing Association or its predecessor.
 6             (3)  Either  (i)  has  completed  a program of study
 7        before  July  1,  2002  that  includes  course  work  and
 8        supervised clinical experience sufficient in breadth  and
 9        depth  to demonstrate knowledge and skills related to the
10        specific problems, methods and procedures  applicable  to
11        students  with  disabilities  in a school setting serving
12        ages  3  through  21  or  (ii)  meets  the  content  area
13        standards for speech-language pathologists adopted by the
14        State Board of Education, in consultation with the  State
15        Teachers Certification Board.
16             (4)  Has   successfully   completed   the   required
17        Illinois certification tests.
18             (5)  Has  paid  the  application  fee  required  for
19        certification.
20        The provisions of this subsection (b) do not preclude the
21    issuance  of  a  teaching  certificate  to  a speech-language
22    pathologist who qualifies for such a certificate.

24        Section 10.  The Illinois Speech-Language  Pathology  and
25    Audiology  Practice  Act is amended by changing Section 7 and
26    adding Section 8.1 as follows:

28        (Section scheduled to be repealed on January 1, 2008)
29        Sec. 7. Licensure requirement.
30        (a)  Except as provided in subsection (b),  on  or  after
31    June  1,  1989,  no  person  shall  practice  speech-language
32    pathology   or  audiology  without  first  applying  for  and

 1    obtaining a license for such  purpose  from  the  Department.
 2    Except  as  provided  in this Section, on or after January 1,
 3    2002, no person shall perform the functions and duties  of  a
 4    speech-language  pathology  assistant  without first applying
 5    for and  obtaining  a  license  for  that  purpose  from  the
 6    Department.
 7        (b)  A  person  holding  a  regular  license  to practice
 8    speech-language pathology or  audiology  under  the  laws  of
 9    another  state,  a  territory  of  the  United States, or the
10    District  of  Columbia  who  has  made  application  to   the
11    Department   for   a   license  to  practice  speech-language
12    pathology or audiology may practice speech-language pathology
13    or audiology without a license for 90 days from the  date  of
14    application  or  until disposition of the license application
15    by the Department, whichever is sooner,  if  the  person  (i)
16    holds  a Certificate of Clinical Competence from the American
17    Speech-Language-Hearing   Association   in    speech-language
18    pathology  or  audiology or, in the case of an audiologist, a
19    certificate from the American Board of Audiology and (ii) has
20    not been disciplined and has no disciplinary matters  pending
21    in a state, a territory, or the District of Columbia.

25        Sec.  8.1.  Temporary  license.  On  and after January 1,
26    2004, a person who has met  the  requirements  of  items  (a)
27    through  (e) of Section 8 and intends to undertake supervised
28    professional experience as a speech-language pathologist,  as
29    required by subsection (f) of Section 8 and the rules adopted
30    by the Department, must first obtain a temporary license from
31    the  Department.  A  temporary  license  may be issued by the
32    Department only to  an  applicant  pursuing  licensure  as  a
33    speech-language   pathologist  in  this  State.  A  temporary

 1    license shall be issued to an applicant upon receipt  of  the
 2    required  fee as set forth by rule and documentation on forms
 3    prescribed by the Department demonstrating  that  a  licensed
 4    speech-language  pathologist  has  agreed  to  supervise  the
 5    professional experience of the applicant. A temporary license
 6    shall  be issued for a period of 12 months and may be renewed
 7    only once for good cause shown.

 8        Section 99. Effective date.  This  Act  takes  effect  on
 9    January 1, 2004.
