 1        AN ACT in relation to public aid.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The  Illinois  Public Aid Code is amended by
 5    adding Section 5-5.23 as follows:

 6        (305 ILCS 5/5-5.23 new)
 7        Sec. 5-5.23.  Rates for  home  health  services.  On  and
 8    after  July  1,  2003,  the  Department  of  Public Aid shall
 9    reimburse  providers  of  home  health  services  under  this
10    Article at the same rates at  which  the  federal  government
11    reimburses  providers  of  those  services under the Medicare
12    program, using the Low Utilization Payment Adjustment  (LUPA)
13    national-average  rate structure. The Department shall adjust
14    those  rates  annually  to  reflect  changes  in   the   LUPA
15    national-average rate structure.

16        Section  99.  Effective  date. This Act takes effect upon
17    becoming law.
