 1        AN ACT concerning libraries.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The Illinois Library System Act is amended by
 5    changing Section 5 as follows:

 6        (75 ILCS 10/5) (from Ch. 81, par. 115)
 7        Sec.  5.   Each  cooperative  public  library  system  or
 8    multitype   library   system   created  by  conversion  of  a
 9    cooperative public library system as provided in Section 4 of
10    this Act shall be governed by a board of directors  numbering
11    at  least  5  and  no  more  than 15 persons.  In cooperative
12    public library  systems  the  members  shall  be  elected  or
13    selected  from  the  governing  boards  of  the participating
14    public libraries.  In multitype  library  systems  the  board
15    shall  be  representative of the variety of library interests
16    in the system, and at least a majority shall  be  elected  or
17    selected  from  the  governing  boards  of  the member public
18    libraries, with not more than  one  director  representing  a
19    single  member  library.  The number of directors, the manner
20    of  election  or  selection,  the  term  of  office  and  the
21    provision for filling vacancies shall be  determined  by  the
22    system  governing board except that all board members must be
23    eligible electors in the geographical area of the system.  No
24    director of any library system, however, shall  be  permitted
25    to serve for more than a total of 6 years unless 2 years have
26    elapsed since his sixth year of service.
27        The board of directors shall elect a president, secretary
28    and treasurer. Before entering upon his duties, the treasurer
29    shall  be required to give a bond in an amount to be approved
30    by the board, but in no case shall such amount be  less  than
31    50%  of  the  system's  area  and  per  capita  grant for the

 1    previous year, conditioned that he will safely keep  and  pay
 2    over upon the order of such board all funds received and held
 3    by  him  for  the  library  system.  The funds of the library
 4    system shall be deposited in  a  bank  or  savings  and  loan
 5    association designated by the board of directors and shall be
 6    expended only under the direction of such board upon properly
 7    authenticated vouchers.
 8        No  bank  or  savings  and loan association shall receive
 9    public funds as permitted by  this  Section,  unless  it  has
10    complied   with  the  requirements  established  pursuant  to
11    Section 6 of the Public Funds Investment Act.
12        The members of the board  of  directors  of  the  library
13    system  shall serve without compensation but their actual and
14    necessary expenses shall  be  a  proper  charge  against  the
15    library fund.
