 1        AN ACT in relation to criminal law.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section 5. The Criminal Code of 1961 is amended by adding
 5    Section 17-26 as follows:

 6        (720 ILCS 5/17-26 new)
 7        Sec. 17-26. Paternity fraud.
 8        (a)  A  person  commits  the  offense  of paternity fraud
 9    when:
10             (1)  he or she knowingly alleges that  a  person  is
11        the biological father of a child; and
12             (2)  he  or  she  knows,  at the time that he or she
13        makes the allegation, that the allegation: (A)  is  false
14        and  (B)  may  result  in  the  person  alleged to be the
15        biological  father   of   a   child   being   erroneously
16        adjudicated as the father of a child.
17        (b)  Sentence.  Paternity fraud is a Class A misdemeanor.
