 1        AN ACT in relation to the regulation of professions.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.   The  Illinois  Architecture Practice Act of
 5    1989 is amended by changing Section 35 as follows:

 6        (225 ILCS 305/35) (from Ch. 111, par. 1335)
 7        (Section scheduled to be repealed on January 1, 2010)
 8        Sec. 35.  Certification of record.  The Department  shall
 9    not  be  required  to certify any record to the court or file
10    any answer in court or otherwise appear in  any  court  in  a
11    judicial  review  proceeding,  unless  there  is filed in the
12    court with  the  complaint  a  receipt  from  the  Department
13    acknowledging   payment   of  the  costs  of  furnishing  and
14    certifying the record.  Failure on the part of the  plaintiff
15    to  file  the  such  receipt  in  court  shall be grounds for
16    dismissal of the action.
