 1        AN ACT concerning education.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.   The  School  Code  is  amended  by changing
 5    Section 10-20.12 as follows:

 6        (105 ILCS 5/10-20.12) (from Ch. 122, par. 10-20.12)
 7        Sec. 10-20.12.  School year - School  age.  To  establish
 8    and keep in operation in each year during a school term of at
 9    least  the  minimum  length  required  by  Section  10-19,  a
10    sufficient  number  of  free schools for the accommodation of
11    all persons in the district who are 5 years of age  or  older
12    but under 21 years of age, and to secure for all such persons
13    the  right  and  opportunity  to  an  equal education in such
14    schools; provided that children who will attain the age of  5
15    years  on  or before September 1 of the year of the 1990-1991
16    school term and each school term through the 2003-2004 school
17    term and December 10 of the year of the 2004-2005 school term
18    and each school term thereafter may attend  school  upon  the
19    commencement  of  such  term.  Based  upon an assessment of a
20    child's readiness to attend school,  a  school  district  may
21    permit  a child to attend school prior to the dates contained
22    in this Section. In any school district operating on  a  full
23    year  school  basis  children who will attain age 5 within 30
24    days after the commencement of a term may attend school  upon
25    the  commencement  of  such term. The school district may, by
26    resolution of its board, allow for a full year school plan.

28        Section 90.  The State Mandates Act is amended by  adding
29    Section 8.27 as follows:

 1        (30 ILCS 805/8.27 new)
 2        Sec.  8.27.  Exempt  mandate.  Notwithstanding Sections 6
 3    and 8 of this Act, no reimbursement by the State is  required
 4    for  the  implementation  of  any  mandate  created  by  this
 5    amendatory Act of the 93rd General Assembly.
