 1        AN ACT in relation to fire protection.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The Illinois Municipal  Code  is  amended  by
 5    changing Section 11-10-2 as follows:

 6        (65 ILCS 5/11-10-2) (from Ch. 24, par. 11-10-2)
 7        Sec. 11-10-2. Department Foreign Fire Insurance Board.  A
 8    department  foreign  fire  insurance board shall exist within
 9    the fire department  of  each  municipality  with  fewer  The
10    corporate  authorities  of  any  municipality containing less
11    than 250,000 inhabitants that which  has  an  organized  fire
12    department.   The  department  shall  provide  shall  pass an
13    ordinance providing for  the  election  of  officers  of  the
14    department foreign fire insurance board by the members of the
15    department.   All members of the department shall be eligible
16    to be elected as officers  of  the  department  foreign  fire
17    insurance  board.   These officers shall include a treasurer,
18    and they shall make all needful rules  and  regulations  with
19    respect  to  the  department foreign fire insurance board and
20    the management of the money to be appropriated to the  board.
21    The  officers  of the department foreign fire insurance board
22    shall develop and maintain a listing of those items that  the
23    board feels are appropriate expenditures under this Act.  All
24    of  the  money paid to the municipal treasurer as provided in
25    Section 11-10-1 shall be set apart and shall be  appropriated
26    annually  by  the  corporate  authorities  to  the department
27    foreign  fire  insurance  board.   The   treasurer   of   the
28    department   foreign   fire  insurance  board  shall  give  a
29    sufficient  bond  to  the  municipality  in  which  the  fire
30    department is organized.  This bond shall be approved by  the
31    mayor  or president, as the case may be, conditioned upon the

 1    faithful performance by the treasurer of his  or  her  duties
 2    under  the  ordinance  and the rules and regulations provided
 3    for in this Section.  The treasurer of the department foreign
 4    fire insurance board shall receive the appropriated money and
 5    shall pay out the money upon  the  order  of  the  department
 6    foreign  fire  insurance  board for the maintenance, use, and
 7    benefit of the department.  As part of the  annual  municipal
 8    audit,  these funds shall be audited to verify that they have
 9    been properly appropriated to  and  held  by  the  department
10    foreign  fire  insurance board and have been expended by that
11    board only these purchases are for the maintenance, use,  and
12    benefit of the department.
13        The  provisions  of  this  Section shall be the exclusive
14    power of the State, pursuant to subsection (h) of  Section  6
15    of Article VII of the Constitution.

17        Section  10.  The Fire Protection District Act is amended
18    by adding Section 11h as follows:

19        (70 ILCS 705/11h new)
20        Sec. 11h.  Department foreign fire insurance board.
21        (a)  A department  foreign  fire  insurance  board  shall
22    exist  within  the  fire  department  of each fire protection
23    district that has an organized fire department.
24        (b)  The department shall provide  for  the  election  of
25    officers  of  the  department  foreign  fire insurance board,
26    including a treasurer.  All members of the  department  shall
27    be  eligible  to  vote  for and be elected as officers of the
28    department foreign fire insurance board.
29        (c)  The  treasurer  of  the  department   foreign   fire
30    insurance  board shall give a sufficient bond to the board of
31    trustees of the fire protection  district,  conditioned  upon
32    the  faithful  performance  by  the  treasurer  of his or her

 1    duties under this Section.  This bond must be approved by the
 2    board of trustees of the fire protection district.
 3        (d)  The  officers  of  the   department   foreign   fire
 4    insurance board shall develop and maintain a listing of those
 5    items that the board feels are appropriate expenditures under
 6    this  Section.  The officers shall make all needful rules and
 7    regulations with  respect  to  the  department  foreign  fire
 8    insurance  board  and  the  management  of  the  money  to be
 9    appropriated to the board.
10        (e)  All of the money paid to the secretary of  the  fire
11    protection  district  under  Section  11-10-1 of the Illinois
12    Municipal Code shall be set apart and shall  be  appropriated
13    annually  by  the  board  of  trustees of the fire protection
14    district to the department foreign fire insurance board.
15        (f)  The  treasurer  of  the  department   foreign   fire
16    insurance  board  shall  receive  the  appropriated money and
17    shall pay out the money upon  the  order  of  the  department
18    foreign  fire  insurance  board for the maintenance, use, and
19    benefit of the department.  As part of  the  fire  protection
20    district's  annual  audit,  these  funds  shall be audited to
21    verify that they have been properly appropriated to and  held
22    by  the department foreign fire insurance board and have been
23    expended by that board only for  the  maintenance,  use,  and
24    benefit of the department.

25        Section  99.  Effective date.  This Act takes effect upon
26    becoming law.
