 1        AN ACT relating to higher education.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section  5.   The  Western  Illinois  University  Law  is
 5    amended by changing  Sections  35-15,  35-20,  and  35-25  as
 6    follows:

 7        (110 ILCS 690/35-15)
 8        Sec.  35-15.  Membership;  terms;  vacancies.   The Board
 9    shall consist of 7 voting members appointed by the  Governor,
10    by  and  with  the  advice and consent of the Senate, and one
11    voting member who is a  student  at  the  campus  of  Western
12    Illinois University at Macomb, and one voting member who is a
13    student  at  the  campus  of  Western  Illinois University at
14    Moline.  Each  The  student  member  shall  be  chosen  by  a
15    campus-wide student election.  Each The student member  shall
16    serve  a  term  of one year beginning on July 1 of each year,
17    except that the student member added by this  amendatory  Act
18    of  the 93rd General Assembly, who must be initially selected
19    from the campus of the  University  not  represented  by  the
20    current  student  member, shall serve a term beginning on the
21    date of his  or  her  selection  and  expiring  on  the  next
22    succeeding  June  30.   To be eligible to remain as a student
23    member of the Board, a the student member must be a  resident
24    of  this  State, must have and maintain a grade point average
25    that is equivalent to at least 2.5 on a 4.0 scale,  and  must
26    be  a  full  time student enrolled at all times during his or
27    her term of office except for that part  of  the  term  which
28    follows  the  completion of the last full regular semester of
29    an academic year and precedes the first full regular semester
30    of the succeeding academic year at the university  (sometimes
31    commonly referred to as the summer session or summer school).

 1    If a student member serving on the Board fails to continue to
 2    meet  or maintain the residency, minimum grade point average,
 3    or enrollment requirement established by this Section, his or
 4    her  membership  on  the  Board  shall  be  deemed  to   have
 5    terminated  by  operation  of  law.   Of  the  members  first
 6    appointed  by the Governor, 4 shall be appointed for terms to
 7    expire on the third Monday in January, 1999, and 3  shall  be
 8    appointed for terms to expire on the third Monday in January,
 9    2001.  If  the Senate is not in session on the effective date
10    of this Article, or if a vacancy in an appointive  membership
11    occurs  at  a  time  when  the  Senate is not in session, the
12    Governor shall make temporary  appointments  until  the  next
13    meeting  of the Senate when he shall nominate persons to fill
14    such memberships for the remainder of their respective terms.
15    No more than 4 of the members appointed by the Governor shall
16    be affiliated with the same  political  party.   Each  member
17    appointed  by  the Governor must be a resident of this State.
18    A failure to meet  or  maintain  this  residency  requirement
19    constitutes  a  resignation from and creates a vacancy in the
20    Board.  Upon the expiration of the terms of members appointed
21    by  the  Governor,  their  respective  successors  shall   be
22    appointed  for  terms  of  6  years  from the third Monday in
23    January of each odd-numbered year. Any members  appointed  to
24    the  Board  shall  continue  to  serve in such capacity until
25    their successors are appointed and qualified.

29        Sec.   35-20.  Reimbursement;   employment   limitations.
30    Members  of  the  Board  shall serve without compensation but
31    shall  be  entitled  to  reasonable  amounts   for   expenses
32    necessarily  incurred  in  the  performance  of their duties.
33    Such expenses incurred by a the student member  may,  at  the

 1    discretion  of  the Chairman of the Board, be provided for by
 2    advance payment to the  student  member,  who  shall  account
 3    therefor to the Board immediately after each meeting.
 4        No  member  of  the Board shall hold or be employed in or
 5    appointed to any office or place under the authority  of  the
 6    Board,  nor  shall  any  member  of  the Board be directly or
 7    indirectly interested in any contract made by the Board,  nor
 8    shall  he  be an employee of the State or Federal Government;
 9    provided that nothing in this  Section  shall  be  deemed  to
10    prohibit  a  the student member of the Board from maintaining
11    normal and official status as an enrolled student  or  normal
12    student employment at Western Illinois University.

15        Sec.  35-25.  Officers;  meetings.   Members of the Board
16    shall elect annually by secret ballot from their own number a
17    chairman who shall preside over meetings of the Board  and  a
18    secretary.
19        Meetings  of  the  Board shall be held at least once each
20    quarter on the  campus  of  Western  Illinois  University  at
21    Macomb,  Illinois.   At  all regular meetings of the Board, a
22    majority of its members shall constitute  a  quorum.   A  The
23    student   member   shall   have  all  of  the  privileges  of
24    membership, including the right to make and  second  motions,
25    to  attend  executive  sessions,  and  to  vote  on all Board
26    matters  except  those  involving  faculty  tenure,   faculty
27    promotion  or  any  issue  on  which the student member has a
28    direct conflict of interest.  Unless a the student member  is
29    entitled  to  vote  on a measure at a meeting of the Board or
30    any of its committees, he or she shall not  be  considered  a
31    member  for  the  purpose  of determining whether a quorum is
32    present at the time that measure is voted upon.  No action of
33    the Board shall be invalidated by reason of any vacancies  on

 1    the  Board  or  by  reason of any failure to select a student
 2    member.
 3        Special meetings of  the  Board  may  be  called  by  the
 4    chairman of the Board or by any 3 members of the Board.
 5        At  each  regular and special meeting that is open to the
 6    public, members of the public and employees of the University
 7    shall be afforded time, subject to reasonable constraints, to
 8    make comments to or ask questions of the Board.
