SYNOPSIS AS INTRODUCED:
 
105 ILCS 5/24-6

    Amends the School Code. Provides that for the purposes of calculating the paid sick leave for the birth of a child or the adoption or placement for adoption of a child: the days do not have to be taken immediately after the birth of the child or the adoption or placement of the child; the days do not have to be taken consecutively; and the school board may not count any day in which school is not in session, including an extended break.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by changing Section
524-6 as follows:
 
6    (105 ILCS 5/24-6)
7    Sec. 24-6. Sick leave. The school boards of all school
8districts, including special charter districts, but not
9including school districts in municipalities of 500,000 or
10more, shall grant their full-time teachers, and also shall
11grant such of their other employees as are eligible to
12participate in the Illinois Municipal Retirement Fund under the
13"600-Hour Standard" established, or under such other
14eligibility participation standard as may from time to time be
15established, by rules and regulations now or hereafter
16promulgated by the Board of that Fund under Section 7-198 of
17the Illinois Pension Code, as now or hereafter amended, sick
18leave provisions not less in amount than 10 days at full pay in
19each school year. If any such teacher or employee does not use
20the full amount of annual leave thus allowed, the unused amount
21shall be allowed to accumulate to a minimum available leave of
22180 days at full pay, including the leave of the current year.
23Sick leave shall be interpreted to mean personal illness,

1quarantine at home, serious illness or death in the immediate
2family or household, or birth, adoption, or placement for
3adoption. The school board may require a certificate from a
4physician licensed in Illinois to practice medicine and surgery
5in all its branches, a chiropractic physician licensed under
6the Medical Practice Act of 1987, a licensed advanced practice
7registered nurse, a licensed physician assistant, or, if the
8treatment is by prayer or spiritual means, a spiritual adviser
9or practitioner of the teacher's or employee's faith as a basis
10for pay during leave after an absence of 3 days for personal
11illness or 30 days for birth or as the school board may deem
12necessary in other cases. If the school board does require a
13certificate as a basis for pay during leave of less than 3 days
14for personal illness, the school board shall pay, from school
15funds, the expenses incurred by the teachers or other employees
16in obtaining the certificate. For paid leave for adoption or
17placement for adoption, the school board may require that the
18teacher or other employee provide evidence that the formal
19adoption process is underway, and such leave is limited to 30
20days unless a longer leave has been negotiated with the
21exclusive bargaining representative.
22    For the purposes of calculating the paid sick leave for the
23birth of a child or the adoption or placement for adoption of a
24child:
25        (1) the days do not have to be taken immediately after
26    the birth of the child or the adoption or placement of the

1    child;
2        (2) the days do not have to be taken consecutively; and
3        (3) the school board may not count any day in which
4    school is not in session, including an extended break.
5    If, by reason of any change in the boundaries of school
6districts, or by reason of the creation of a new school
7district, the employment of a teacher is transferred to a new
8or different board, the accumulated sick leave of such teacher
9is not thereby lost, but is transferred to such new or
10different district.
11    For purposes of this Section, "immediate family" shall
12include parents, spouse, brothers, sisters, children,
13grandparents, grandchildren, parents-in-law, brothers-in-law,
14sisters-in-law, and legal guardians.
