Synopsis As Introduced Creates the Illinois Justice Study Committee to review all non-capital wrongful conviction cases, identify the most common causes of wrongful conviction in non-capital cases, identify current law, and identify solutions.
Senate Committee Amendment No. 1 Changes the date by which the Committee shall submit its final report to the Governor and General Assembly from June 1, 2008 to December 31, 2008.
House Committee Amendment No. 1 Provides that of the 3 members of the Committee appointed by the Governor, 2 shall be experienced in criminal law. Decreases from 3 to 2, the number of members of the Committee appointed each by the Speaker of the House of Representatives and President of the Senate. Limits the Committee's review to non-capital wrongful felony convictions (rather than all non-capital convictions).
House Floor Amendment No. 2 Provides that the Illinois Justice Study Committee may (rather than shall) consider whether the State of Illinois should put into place a procedure for addressing claims of factual innocence before appellate review of a conviction.
