Replaces everything after the enacting clause. Amends the Prevailing Wage Act. Provides that contractors and subcontractors shall make and keep for a period of not less than 10, currently 3, years from the date of the last payment on a contract or subcontract for public works records of all workers employed on the project. Provides that a public body must keep for 10, currently 3, years certain payroll records. Provides that the relevant period for consideration by the Department of Labor of multiple violations shall be 10, rather than 5, years. Provides that actions for the failure to pay wages or compensation shall be brought within 10 years from the date of the failure to pay.

Senate Floor Amendment No. 2
Replaces everything after the enacting clause. Reinserts the provisions of the engrossed bill with the following changes: Provides that contractors and subcontractors shall make and keep for a period of not less than 5 (rather than 10) years from the date of the last payment on a contract or subcontract for public works records of all workers employed on the project. Provides that a public body must keep for 5 (rather than 10) years certain payroll records. Provides that a contractor, subcontractor, or public body may retain records in paper or electronic format. Provides that actions for the failure to pay wages or compensation shall be brought within 5 (rather than 10) years from the date of the failure to pay. Removes amendatory changes that require the Department of Labor to determine the contractors or subcontractors who, before the effective date of this amendatory Act, have been determined to have violated the provisions of the Prevailing Wage Act on 2 separate occasions within 5 years and who, on or after the effective date of this amendatory Act, have been determined to have violated the provisions of the Prevailing Wage Act of 2 separate occasions within 7 years.
