Synopsis As Introduced
Amends the School Code. In provisions concerning the educational services block grant for a school district having a population exceeding 500,000 inhabitants, provides that the grant shall include funding for children requiring special education services. Removes the extraordinary and private tuition components of the Special Education program that the educational services block grant includes. In provisions concerning children with disabilities attending private schools, public out-of-state schools, public school residential facilities, or private special education facilities, removes the requirement that transportation to and from home to a residential school more than once each school term be subject to prior approval by the State Superintendent of Education. Replaces certain provisions in the Children with Disabilities Article of the School Code concerning State reimbursement to a school district with new provisions governing payments for children requiring special education services. Effective immediately.

Deletes reference to:
105 ILCS 5/14-7.02

In the provision concerning the educational services block grant for the Chicago school district, restores the private tuition component of the Special Education program that the block grant includes. Restores current law with respect to the provisions concerning children with disabilities attending private schools, public out-of-state schools, public school residential facilities, or private special education facilities. Makes changes concerning the funding formula for children requiring special education services, payments for individual students with disabilities whose program costs exceed 4 times the district's per capita tuition rate, and grants for approved summer school programs for children with disabilities.

House Committee Amendment No. 2
In the new Section concerning funding for children requiring special education services, removes the provision that provides that funds may be used only for the provision of special educational facilities and services as defined in the Article of the School Code concerning children with disabilities.

Governor Amendatory Veto Message
Recommends that the base level funding apply only for fiscal year 2004.
