Synopsis As Introduced
Amends the State Officials and Employees Ethics Act. Provides that any member of a board or commission whose appointment requires the advice and consent of the Senate and who receives a salary from the State must either (1) divest himself or herself of any funds supporting his or her candidacy for any federal, State, or local public office by (A) a direct return of funds to contributors in amounts not to exceed his or her individual contributions, (B) a transfer of funds to a charitable organization or organizations, or (C) a combination of items (A) and (B), or (2) have the funds placed in an account that is frozen for the duration of his or her term as a member of the board or commission, except for account activity related to covering the reasonable costs of maintaining the account. Provides that failure to comply with this Section shall render the office vacant. Effective immediately.

Senate Floor Amendment No. 1
Adds reference to:
10 ILCS 5/9-8.7 new

Replaces everything after the enacting clause. Amends the State Officials and Employees Ethics Act and the Election Code. Provides that any member of a board or commission (i) whose appointment requires the advice and consent of the Senate, (ii) who is confirmed by the Senate, who holds office by a temporary appointment made under Section 9 of Article V of the Illinois Constitution, or who is appointed by the Governor as an acting member, and (iii) who receives a salary from the State for serving on that board or commission must divest or freeze the funds in any candidate political committee maintained or controlled by the member and may not establish a candidate political committee for the duration of his or her term on the board or commission. Provides that failure to divest or freeze those funds will result in forfeiture of those funds. Provides that an appointed member of a board or commission who establishes a candidate political committee during his or her term on the board or commission shall be subject to a $5,000 fine. Provides that a member may maintain his or her committee for the purpose of paying any debt owed by that member's committee if the debt was incurred by the committee prior to the member's appointment. Provides that the committee may make payments on the committee's outstanding debt, pay reasonable costs of maintaining the account or preparing reports, and accept certain contributions from the member and the member's spouse, parent, sibling, or child. Effective immediately.

Further amends the State Officials and Employees Ethics Act. Provides that the revolving door prohibition does not apply to former officers, members, or State employees who accept employment from any federal, State, or local governmental unit.
