Amends the Cemetery Oversight Act. Makes a technical change in a Section concerning the short title.

Replaces everything after the enacting clause. Amends the Counties Code. Provides that, if the police department of any city, town, or county investigates abandoned cremated remains and can not locate the owner of the cremated remains that are also considered as human remains, then the police shall deliver such human remains to the coroner, and the coroner shall cause the human remains to be disposed of as otherwise provided in provisions of that Act. Amends the Cemetery Oversight Act. Makes changes in the definition of "family burying ground" and "lawn crypt". Effective immediately.

Replaces everything after the enacting clause. Creates the Cemetery Consumer Bill of Rights Act. Provides that consumers have the right to purchase cemetery merchandise or cemetery services directly from a cemetery authority or third-party vendor of the consumer's choice without incurring a penalty or additional charges by the cemetery authority. Provides that all prices for cemetery merchandise and cemetery services must be disclosed to the consumer in writing on a standardized price list. Amends the Counties Code to provide that for any abandoned cremated remains where the owner cannot be located, the county coroner of the county where the human cremated remains where found shall cause the human remains to be disposed of according to the Act. Amends the Cemetery Oversight Act. Makes changes in provisions concerning definitions, exemptions, powers of the Department, licensure, qualifications for licensure, the Code of Professional Conduct and Ethics, examination, fees, maintenance and records, contracts, citations, grounds for disciplinary action, mandatory reports, investigations, receivership, violations, civil penalties, and the Cemetery Oversight Board. Adds provisions concerning renewal. Repeals various provisions of the Act. Makes other changes. Amends the Crematory Regulation Act. Repeals various provisions of the Act. Also amends the Vital Records Act. Contains a severability clause. Effective immediately.

Adds reference to:

Removes the Attorney General's office from the provision concerning who the consumers may contact to register a complaint regarding violations of the Act. Amends the Vital Records Act to make changes to the provision concerning information required on forms. Provides that the depth of the disposition of the human remains shall be included on the burial permit, if applicable. Makes technical changes in provisions concerning consumer privileges; cemetery duties for all cemetery authorities; rights of consumers; consumer complaints; violations; and grounds for disciplinary action. Makes other changes.

 Housing Affordability Impact Note (Housing Development Authority)
 This bill will have no effect on the cost of constructing, purchasing, owning, or selling a single-family residence.

 Pension Note (Government Forecasting & Accountability)
 SB 1853 will not impact any public pension fund or retirement system in Illinois.

 State Debt Impact Note (Government Forecasting & Accountability)
 SB 1853 would not change the amount of authorization for any type of State-issued or State-supported bond, and, therefore, would not affect the level of State indebtedness.

 Land Conveyance Appraisal Note (Dept. of Transportation)
