Synopsis As Introduced
Amends the Home Repair and Remodeling Act. Provides that a residential contractor shall not advertise or promise to pay or rebate all or any portion of any insurance deductible as an inducement to the sale of goods or services. Provides that a person who has entered into a written contract with a residential contractor to provide goods or services to be paid from the proceeds of a property and casualty insurance policy may cancel the contract prior to midnight on the fifth business day after the insured has received written notice from the insurer that all or any part of the claim or contract is not a covered loss under the insurance policy. Requires a residential contractor to provide a statement informing the insured about his or her right to cancel and a pre-made form for him or her to do so. Provides that within 10 days of such a cancellation, the residential contractor shall return all payments made by the insured, except for emergency services provided by the contractor and agreed to by the insured. Provides that a residential contractor shall not represent or negotiate, or offer or advertise to represent or negotiate, on behalf of an owner or possessor of residential real estate on any insurance claim in connection with the repair or replacement of roof systems, or the performance of any other exterior repair, replacement, construction, or reconstruction work.

Replaces everything after the enacting clause. Amends the Home Repair and Remodeling Act. Provides that a contractor offering home repair or remodeling services shall not advertise or promise to pay or rebate all or any portion of any insurance deductible as an inducement to the sale of goods or services. Provides that such a contractor shall not accept money or any form of compensation in exchange for allowing an out of area contractor to use its business name or license. Provides that a person who has entered into a written contract with a contractor to provide goods or services to be paid from the proceeds of a property and casualty insurance policy may cancel the contract prior to midnight on the earlier of the fifth business day after the insured has received written notice from the insurer that all or any part of the claim or contract is not a covered loss under the insurance policy or the thirtieth business day after receipt of a properly executed proof of loss by the insurer from the insured. Requires a contractor to provide a statement informing the insured about his or her right to cancel and a pre-made form for him or her to do so. Provides that within 10 days of such a cancellation, the contractor shall return all payments made by the insured, except for services related to a catastrophe provided by the contractor and agreed to by the insured. Provides that a contractor offering home repair or remodeling services shall not represent, or offer or advertise to represent, on behalf of a homeowner on any insurance claim in connection with the repair or replacement of roof systems, or the performance of any other exterior repair. Provides additions to what must be included in the corresponding consumer rights brochure. Makes other changes.

Amends the Illinois Roofing Industry Licensing Act. Provides that any entity offering services regulated by the Roofing Industry Licensing Act shall affix the roofing contractor license number and the licensee's name, as it appears on the license, on all commercial vehicles used in offering such services. Provides a $250 civil penalty for noncompliance and that local code enforcement officials may enforce the penalty. Provides that a contractor offering home repair or remodeling services shall not represent, or offer or advertise to represent, on behalf of a homeowner on any insurance claim in connection with the performance of any interior repair, replacement, construction or reconstruction work, in addition to the same exterior work and repair and replacement of roof systems. Defines Public Adjuster. Makes changes to the consumer rights brochure.
