Synopsis As Introduced
Amends the Nursing Home Care Act. Provides that the Department of Public Health's placement of a monitor in a long-term care facility shall be for the purpose of working with the facility in a collaborative manner to achieve compliance with State regulations. Provides that the monitor shall file a written report (instead of report periodically) with the Department and also with the facility. Requires the monitor to participate in a meeting with the Department's regional representative and the facility. Effective immediately.

House Floor Amendment No. 1
Replaces everything after the enacting clause. Reinserts the introduced bill with changes. Provides that when a monitor is placed in a facility in any situation described in a specified provision of the Act, the monitor shall observe operation of the facility, shall assist the facility by advising it on how to comply with the State regulations, and shall report periodically to the Department on the operation of the facility. Provides that reports from the monitor shall be submitted to the Department on the first day of each month. Provides that upon written request by the facility, the Department shall provide the facility with a redacted copy of the report, subject to confidentiality restrictions and with the name, room number, or any other characteristic that may enable the specific person to be identified who has given information to the monitor deleted. Provides that the monitor reports shall not be subject to the Freedom of Information Act. Provides that a facility may submit to the Department and the monitor a statement refuting any of the statements or disputing any of the recommendations contained in the monitor report. Effective immediately.

Replaces everything after the enacting clause. Contains a statement of legislative purpose and intent. Amends the Code of Civil Procedure. Provides that certain provisions concerning the Making Home Affordable Program become inoperative on January 1, 2014 (instead of January 1, 2013) for all mortgage foreclosure actions filed after December 31, 2013 (instead of December 31, 2012) in which the mortgagor did not apply for assistance under the Making Home Affordable Program on or before December 31, 2013 (instead of December 31, 2012). Amends Public Act 97-849 by providing that Sections of the Public Act concerning the High Risk Home Loan Act take effect on the effective date of the federal regulations implementing Sections 1431, 1432, and 1433 of the federal Dodd-Frank Wall Street Reform and Consumer Protection Act (instead of January 1, 2013). Effective immediately.
