Synopsis As Introduced
Amends the Good Samaritan Act. Provides that any person who in good faith (instead of any person currently certified in basic cardiopulmonary resuscitation who complies with generally recognized standards, and who in good faith), not for compensation, provides emergency cardiopulmonary resuscitation to a person who is an apparent victim of acute cardiopulmonary insufficiency shall not, as the result of his or her acts or omissions in providing resuscitation, be liable for civil damages, unless the acts or omissions constitute willful and wanton misconduct. Effective immediately.

House Committee Amendment No. 1
Replaces everything after the enacting clause with provisions similar to the bill. Provides that any person trained (instead of currently certified) in basic cardiopulmonary resuscitation who in good faith, not for compensation, provides emergency cardiopulmonary resuscitation in accordance with his or her training (instead of who complies with generally recognized standards) to a person who is an apparent victim of acute cardiopulmonary insufficiency shall not, as the result of his or her acts or omissions in providing resuscitation, be liable for civil damages, unless the acts or omissions constitute willful and wanton misconduct. Effective immediately.

House Floor Amendment No. 2
Adds reference to:
745 ILCS 49/12

Replaces everything after the enacting clause. Further amends the Good Samaritan Act. Provides that any person trained (instead of currently certified) in basic cardiopulmonary resuscitation who has successfully completed training or any automated external defibrillator user who has successfully completed training, in accordance with the standards of the American Red Cross or the American Heart Association, and who in good faith, not for compensation, provides emergency care in accordance with his or her training to a person who is need of either cardiopulmonary resuscitation or a defibrillator shall not, as the result of his or her acts or omissions in providing emergency care, be liable for civil damages, unless the acts or omissions constitute willful and wanton misconduct. Effective immediately.

Senate Committee Amendment No. 1
Deletes reference to:
745 ILCS 49/12

Further amends the Good Samaritan Act. Deletes provisions from the bill that modified existing provisions concerning the use of an automated external defibrillator.
