Synopsis As Introduced
Amends the Public Building Commission Act. Authorizes a Commission to solicit and award design-build construction contracts.

House Committee Amendment No. 1
Provides that the potential subcontractors who must be identified in a design-build proposal are with respect to the 5 subdivisions of construction work specified in Section 30-30 of the Illinois Procurement Code.

 Housing Affordability Impact Note (Housing Development Authority)
 This legislation will have no effect on constructing, purchasing, owning, or selling a single-family residence.

 Fiscal Note (Office of the Comptroller)
 A review of the legislation does not reveal any significant fiscal impact to the operations of the Office of the Comptroller or to the State government. Moreover, an appropriate State entity that may be in a better position to determine the impact to the State operations might be the Capital Development Board or the Procurement Policy Board.

 Home Rule Note, House Committee Amendment No. 1 (Dept. of Commerce & Economic Opportunity)
 It is the opinion of the Department of Commerce and Economic Opportunity that HB 3490 (H-AM 1) does not pre-empt home rule authority

Senate Committee Amendment No. 1
Adds reference to:

Deletes everything after the enacting clause. Reinserts engrossed House bill 3490 with the following changes: Adds legislative intent and conditions for a commission's use of design-build. Requires that a commission annually report to the General Assembly on the use of minority and female owned enterprises with respect to design-build projects. Limits a commission's use of design-build to no more than 25% of its annual construction budget. Repeals the bill's design-build provisions 5 years after the bill's effective date.

Senate Floor Amendment No. 2
Deletes everything after the enacting clause. Reinserts Senate Amendment No. 1 with the following changes: Requires that the building commission require that the design-build entity comply with utilization goals for minority and women businesses and with equal employment provisions of the Illinois Human Rights Act (now, prohibits a commission from using the design-build procurement method unless it determines in writing that the project will comply with the State's disadvantaged business and equal employment practices). Limits a commission's annual design-build payments to 25% of its fiscal year moneys for construction projects (now, no more than 25% of a commission's annual construction budget may be used for design-build projects).
