Synopsis As Introduced
Amends the Tobacco Accessories and Smoking Herbs Control Act. Provides that a person may not knowingly sell, distribute, or offer for sale or distribution in this State or to any person in this State any tobacco product or any component part thereof (including but not limited to the tobacco, paper, or filter, and any components for roll-your-own cigarettes), which contains a constituent (including a smoke constituent) or additive or artificial or natural flavoring that produces a characterizing flavor. Provides that a violation is a Class C misdemeanor.

Replaces everything after the enacting clause. Amends the Sale of Tobacco to Minors Act. Provides that a minor under 18 years of age in the furtherance or facilitation of obtaining any cigar, cigarette, smokeless tobacco, or tobacco in any of its forms shall not display or use a false or forged identification card or transfer, alter, or deface an identification card. Provides that tobacco products may be sold through a vending machine only if such tobacco products are not placed together with any non-tobacco product, other than matches, in the vending machine. Provides that the sale or distribution by any person of a tobacco product, including but not limited to a single or loose cigarette, that is not contained within a sealed container, pack, or package as provided by the manufacturer, which container, pack, or package bears the health warning required by federal law, is prohibited. Eliminates provisions that permit tobacco vending machines in: (1) factories, businesses, offices, private clubs, and other places not open to the general public; (2) places where alcoholic beverages are sold and consumed on the premises; and (3) places where the vending machine is under the direct supervision of the owner of the establishment or an employee over 18 years of age.

Amends the Tobacco Accessories and Smoking Herbs Control Act. Provides that no person shall knowingly sell, distribute, or offer for sale or distribution in this State or to any person in this State a flavored cigarette. Provides that a public statement or claim by the manufacturer or by any person authorized or permitted by the manufacturer to make public statements concerning a cigarette, that the cigarette has or produces a flavor, taste, or aroma (other than tobacco or menthol) shall constitute proof that the cigarette has a characterizing flavor and is a flavored cigarette.

Senate Floor Amendment No. 2
Replaces everything after the enacting clause. Reinserts the provisions of the bill, as amended. In the amendatory changes to the Tobacco Accessories and Smoking Herbs Control Act, deletes provision that a public statement or claim by the manufacturer or by any person authorized or permitted by the manufacturer to make public statements concerning a cigarette, that the cigarette has or produces a flavor, taste, or aroma (other than tobacco or menthol) shall constitute proof that the cigarette has a characterizing flavor and is a flavored cigarette. Changes the definition of "characterizing flavor". Also, in the amendatory changes to the Tobacco Accessories and Smoking Herbs Control Act, changes references in the purpose Section from children and youth to minors.
