750/40/Act title
750 ILCS 40/3from Ch. 40, par. 1453

Deletes everything. Amends the Frauds Act and the Illinois Parentage Act. In the Frauds Act, creates an exception to the requirement of a writing in the case of the paternity of a child conceived by artificial insemination as provided in the Illinois Parentage Act. Changes the full title of the Illinois Parentage Act so that it refers to "a child born to a woman and a man" (instead of to a wife and husband). Provides that if, with the consent of the intended father of the child (instead of "her husband"), a woman (instead of "a wife") is inseminated artificially with semen donated by a man other than the intended father (instead of by "a man not her husband"), the intended father (instead of husband) shall be treated in law as if he were the natural father of the child thereby conceived. Provides that the consent shall (instead of must) be in writing or may be inferred from the intended father's conduct evidencing his actual consent to the artificial insemination procedure.

House Floor Amendment No. 1
Provides that if, with the consent of the intended legal father of the child (instead of "her husband"), a woman (instead of "a wife") is inseminated artificially with semen donated by a man other than the intended legal father (instead of by "a man not her husband"), the intended legal father (instead of husband) shall be treated in law as if he were the natural father of the child thereby conceived. Provides that the consent shall (instead of must) be in writing or may be inferred from clear and convincing evidence that the intended legal father consented to the artificial insemination procedure.
