Synopsis As Introduced
Creates the Physical Fitness Facility Medical Emergency Preparedness Act. Requires various physical fitness facilities, including (i) facilities owned or operated by a unit of local government or by a school, college, or university, (ii) golf courses, and (iii) health or fitness clubs, to develop and implement a plan for responding to medical emergencies and to file a copy of the plan with the Department of Public Health. Requires each such facility to have on its premises at least one automated external defibrillator (AED) and a trained AED user. Authorizes the Department of Public Health to inspect physical fitness facilities to investigate complaints and to ensure compliance with the Act. Authorizes the Department to impose monetary penalties for violations of the Act. Amends the Use Tax Act, the Service Use Tax Act, the Service Occupation Tax Act, and the Retailers' Occupation Tax Act to provide a tax exemption for private physical fitness facilities in connection with the purchase of AEDs.

House Committee Amendment No. 1
Changes the title of the bill to "AN ACT in relation to health, which may be known as the Colleen O'Sullivan Law" (instead of "AN ACT in relation to health").

 State Debt Impact Note (Illinois Economic and Fiscal Commission)
 HB 43 would not change the amount of authorization for any type of State-issued or State-supported bond, and, therefore, would not affect the level of State indebtedness.

Deletes everything after the enacting clause and reinserts the provisions of the bill as introduced, with the following change: amends the State Mandates Act to require implementation without reimbursement by the State.

Senate Floor Amendment No. 2
Adds reference to:
410 ILCS 4/30

Deletes everything after the enacting clause and reinserts the provisions of the engrossed bill, but with changes that include the following: (1) makes the Physical Fitness Facility Medical Emergency Preparedness Act applicable only to indoor facilities that are supervised by one or more persons other than maintenance or security personnel; (2) provides that a facility must ensure that there is a trained AED user on staff; (3) in connection with liability, provides that a right of action does not exist in connection with the use or non-use of an AED at a facility, provided that the person or entity operating the facility has adopted a medical emergency preparedness plan, has an AED at the facility, and has maintained the AED in accordance with Department of Public Health rules; (4) changes the end of the period of tax exemption to December 31, 2007 (instead of 2006); and (5) amends the Automated External Defibrillator Act to provide that a unit of State or local government or school district (as well as a "person") is not liable for civil damages as a result of an act or omission involving the use of an AED and to provide immunity for "an" (instead of "a trained") AED user.

Senate Floor Amendment No. 3
Provides that the Automated External Defibrillator Act provisions concerning exemption from civil liability do not apply to a public hospital.
