Synopsis As Introduced
Amends the Clerks of Court Act. Provides that no fees other than the filing fee for adoption may be charged to any person in connection with proceedings for the appointment of a confidential intermediary under the Adoption Act. Effective immediately.

Deletes everything after the enacting clause. Amends the Adoption Act. Removes the witness signature lines from Information Exchange Authorization and the Denial of Information Exchange forms. Deletes existing provisions concerning confidential intermediaries and adds other provisions with numerous changes concerning their appointments, powers, and duties. Provides that the court may appoint a confidential intermediary if the court finds that the disclosure is of greater benefit than nondisclosure. Provides that the confidential intermediary shall not be authorized to have access to medical records, financial records, credit records, banking records, attorney file records, or other personal records. Provides that the confidential intermediary shall not have access to any personal health information protected by the Standards for Privacy of Individually Identifiable Health Information adopted by the U.S. Department of Health and Human Services under the Health Insurance Portability and Accountability Act of 1996 unless the confidential intermediary has obtained written consent from the person whose information is being sought or, if that person is a minor child, the person's parent or guardian. Provides for the release of information from the Illinois Adoption Registry to an adopted person, adoptive parent, or legal guardian who is a registrant of the Illinois Adoption Registry and specifies the information that shall be released. Creates the Confidential Intermediary Advisory Council under the Department of Children and Family Services. Provides for the membership and duties of the Council. Adds sanctions for improper disclosure of confidential information identifying a sought-after relative.
