Synopsis As Introduced
Amends the Illinois Public Aid Code. Provides that within 90 days after the effective date of this amendatory Act, the Illinois Department of Healthcare and Family Services shall seek federal approval to amend the State Medicaid Plan to disregard applicant income up to 115% of the Federal Poverty Level in applying the income eligibility requirements for the Qualified Medicare Beneficiary, Special Low Income Beneficiary, and Qualified Individual programs. Effective immediately.

Adds reference to:
305 ILCS 5/5-2from Ch. 23, par. 5-2

Replaces everything after the enacting clause. Amends the Illinois Public Aid Code. In provisions concerning the Medicaid eligibility of persons with disabilities who are employed, adds (subject to federal approval) persons with a medically improved disability who are employed and eligible under a specified provision of the Social Security Act. Provides that neither the Governor nor any agency or agency head under the jurisdiction of the Governor has any rulemaking authority under the amendatory Act, but that the Governor may suggest rules by filing them with the General Assembly and requesting that the General Assembly authorize such rulemaking by law, enact the suggested rules into law, or take other appropriate action in the General Assembly's discretion. Effective immediately.
