Illinois General Assembly - Bill Status for HB4526

Amends the Environmental Protection Act. Beginning January 1, 2013, authorizes the use of (i) perchloroethylene drycleaning machines that have only a primary control system, but only for the remainder of each machine's useful life and at the facility at which it is located on the effective date of the amendatory Act and (ii) perchloroethylene drycleaning machines that have primary and secondary control systems. Beginning January 1, 2014, prohibits a person from operating a drycleaning machine unless (i) a person with specified training is present at the facility during the machine's operation and (ii) certain secondary containment measures are in place. Requires manufacturers of drycleaning solvents or other cleaning agents used in drycleaning to provide the Agency with certain information about those products. Requires the Agency, by no later than January 1, 2016, to submit to the General Assembly a report on the impact to groundwater from newly discovered releases of perchloroethylene in the State. Defines "drycleaning", "drycleaning machine", "drycleaning solvents", "perchloroethylene drycleaning machine", "primary control system", "refrigerated condenser", and "secondary control system". Effective January 1, 2013.

Requires a person with specified training to be present during the operation of any perchloroethylene drycleaning machine (rather than during the operation of any drycleaning machine). Requires proof of the completion of the specified training to be posted at only drycleaning facilities where one or more perchloroethylene drycleaning machines are used (rather than at all drycleaning facilities). Authorizes the training requirement in the engrossed bill to be satisfied through completion of specified training under the Drycleaner Environmental Response Trust Fund Act. Requires the Environmental Protection Agency to report newly discovered releases of perchloroethylene from sources in the State (rather than newly discovered releases of perchloroethylene in the State). Amends the Drycleaner Environmental Response Trust Fund Act. Provides that, beginning January 1, 2013, license renewal application forms must contain certain information concerning compliance with federal and state laws, and license renewal applications must include copies of certain hazardous waste manifests. Provides that if the Drycleaner Environmental Response Trust Fund Council does not receive a copy of a required manifests within 3 years, then it may inquire into the management of hazardous waste at the applicable facility and share the results of that inquiry with the Environmental Agency.
