Synopsis As Introduced
Creates the Business Mandate Note Act. Provides that every bill the purpose or effect of which is to directly increase the cost of doing business in the State shall have prepared for it, before second reading in the house of introduction, a brief explanatory statement or note that shall include a reliable estimate of the anticipated impact. Provides that the Department of Commerce and Economic Opportunity shall prepare the business mandate note. Provides that the Department shall collect and maintain information on business mandates. Effective immediately.

House Floor Amendment No. 1
Provides that nothing in the Act shall be construed to conflict with the Illinois Administrative Procedure Act.

Senate Floor Amendment No. 2

5 ILCS 420/3A-40

Replaces everything after the enacting clause. Amends the Illinois Governmental Ethics Act. Provides that an individual appointed by the Governor with the advice and consent of the Senate before August 26, 2011 whose term has expired shall not continue in office longer than 60 calendar days after the expiration of his or her term of office. Creates a vacancy in that office at the end of the 60-day period. Provides that, if such a person is nominated by the Governor before August 26, 2011, and if his or her term of office expires more than 60 days prior to the effective date of the amendatory Act, then that office is considered vacant on the effective date of the amendatory Act, and that vacancy shall be filled only pursuant to the law applicable to making appointments to that office. Effective immediately.

Senate Floor Amendment No. 3
Adds reference to:
820 ILCS 305/14from Ch. 48, par. 138.14

Amends the Workers' Compensation Act. Provides that all arbitrators shall be appointed by the Governor with the advice and consent of the Senate (currently the initial appointments of arbitrators made under P.A. 97-68 are made by the Governor with the advice and consent of the Senate, with all appointments thereafter being made by the Commissioner with the advice and consent of the Commission).
