Synopsis As Introduced
Amends the Freedom of Information Act. Changes a subsection cross-reference in provisions governing a public body's request response period. Effective immediately.

Replaces everything after the enacting clause. Amends the Freedom of Information Act. Requires a public body to respond to a vexatious request for records within 21 working days (instead of 5 business days). Authorizes the public body to respond to such a request by (i) providing an estimate of the time and fees required before the requested records will be copied, (ii) denying the request using one of the statutory exemptions, (iii) notifying the requester that the request is unduly burdensome and extending an opportunity to the requester to reduce the request to manageable proportions, or (iv) providing the requested records. Requires the Public Access Counselor to adopt procedures to create and maintain a log that public bodies can use for tracking vexatious requests for records. Prohibits review by the Public Access Counselor of vexatious requests for records. Defines "vexatious request for records". Also makes technical changes.

Senate Committee Amendment No. 2
Provides that the phrase "vexatious request" does not include a request made by news media if the principal purpose of the request is (i) to access and disseminate information concerning news and current or passing events or (ii) for articles of opinion or features of interest to the public.
