Synopsis As Introduced
Amends the State Universities Article of the Illinois Pension Code. Provides that if an employer notifies the State Universities Retirement System that it has employed an annuitant for more than 100 paid days or 500 paid hours in a school year, then the System shall certify to the employer the current value of the annual retirement annuity of that annuitant. Provides that if an employer receives such a certification, then the employer shall pay the certified amount to the System within one year after receiving the certification. Amends the University of Illinois Act, Southern Illinois University Management Act, Chicago State University Law, Eastern Illinois University Law, Governors State University Law, Illinois State University Law, Northeastern Illinois University Law, Northern Illinois University Law, Western Illinois University Law, and Public Community College Act to make conforming changes. Effective July 1, 2012.

Replaces everything after the enacting clause. Amends the State Universities Article of the Illinois Pension Code concerning annuitants who return to employment. Requires notification and documentation of persons receiving a retirement annuity who are employed by university and community college employers. Defines "affected annuitant" as a person who, while receiving a retirement annuity, has been employed by a university or community college employer for more than 18 paid months and has received earnings in one academic year of more than 40% of his or her highest annual rate of earnings. Provides that the employer of an affected annuitant must pay to the System an employer contribution equal to the annuitant's annual retirement annuity. Provides procedures, payment deadlines, and penalties for noncompliance. Provides an exception for an annuitant who is paid only from federal, foundation, or trust funds that are contingent upon the employment of that specific annuitant. Authorizes the System to audit employers. Extends from 90 to 180 days the period in which a participant in the portable benefit package may elect an optional form of retirement benefit. Also makes administrative and technical changes and corrects terminology relating to participants and annuitants, disability and disability retirement benefits, calculation of interest, and termination of employment. Effective July 1, 2012.

House Floor Amendment No. 2
In language relating to compensation paid from federal, foundation, or trust funds, removes the condition that the funding is contingent upon the employment of a specific annuitant. Makes other changes relating to the employer's required notice to the System, the certification of records by the System, and the calculation of interest.

Senate Committee Amendment No. 1
Moves the implementation and effective dates back by one year.

Senate Floor Amendment No. 2
Replaces everything after the enacting clause. Reinserts the provisions of the engrossed bill with the following changes. Moves the implementation date back one year. Prohibits compensation that comes from corporate funds or grants of State funds that identify the principal investigator by name from being used to calculate whether a person qualifies as an affected annuitant upon whose behalf the employer must make additional employer contributions. Provides that if an employer employs an affected annuitant in order to continue critical operations in the event of either an employee's unforeseen illness, accident, or death or a catastrophic incident or disaster, then, for one and only one academic year, the employer is not required to pay the additional contribution for that annuitant. Defines the terms "academic year" and "critical operations". Effective July 1, 2012.
