Synopsis As Introduced
Amends the Counties Code. Provides for a public policy recital concerning the reasons for regulating adult entertainment facilities. Provides that provisions requiring a one-mile separation between an adult entertainment facility and other specific land uses shall not be enforced if enforcement would fail to allow adult entertainment facilities reasonable alternative avenues of communications. Modifies the definition of "adult entertainment facility." Adds severability clauses. Limits home rule powers. Makes similar changes to the Illinois Municipal Code and provides that adult entertainment facility ordinances may be enforced in the circuit court by the State's Attorney, Attorney General, and persons authorized to bring an action to enjoin zoning violations. Effective immediately.

House Committee Amendment No. 1
Modifies the home rule limitations to exclude home rule units from lessening the required distance between an adult entertainment facility and other specified land uses to less than 250 feet from the home rule unit's border (currently, just 250 feet).

House Floor Amendment No. 2
Amends the Counties Code and the Illinois Municipal Code. In listings of the types of property that an adult entertainment facility may not be located within 3,000 feet of, removes four references to forest preserves (in addition to the two references to forest preserves removed in the bill as introduced).

House Floor Amendment No. 3
Changes the home rule exclusions from a denial or limitation on exercises of power to a concurrent exercise of power and modifies the language of the exclusion.

Senate Committee Amendment No. 1
Modifies the home rule limitations by prohibiting an ordinance, rule, or any other method allowing an adult entertainment facility to operate less than 250 feet from the home rule unit's boundaries (currently, lessen the distance between a specified land use which is 250 feet from the home rule unit's boundaries).

Senate Floor Amendment No. 4
Replaces everything after the enacting clause. Reinserts the engrossed bill with the following changes: Provides that, in addition to other limitations described in the Section, a unit of local government, including home rule units, (presently, only home rule units) may not enact an ordinance or rule, or otherwise allow an adult entertainment facility to operate within 250 feet of the property boundaries of any school, day care center, cemetery, public park, public housing, place of religious worship, or residence when any part of that school, day care center, cemetery, public park, public housing, place of religious worship, or residence is located in an adjacent unit of local government.
