Synopsis As Introduced
Amends the Illinois Procurement Code. Requires that State contracts include the contractor's certification that services performed under the contract or a subcontract shall be performed within the United States. Requires the Procurement Policy Board to establish any exemptions. Requires that a contract be voided for violation of the certification if the chief procurement officer deems it to be in the best interest of the State.

Senate Floor Amendment No. 3
Deletes everything. Amends the Illinois Procurement Code. Requires prospective vendors, prior to contracting or as a requirement of solicitation of any State contracts for services, to disclose in a statement of work any services under that contract and any subcontracts that are anticipated to be performed outside the United States. Authorizes the Chief Procurement Officer to consider the disclosure in awarding the contract or evaluating the bid or offer, provided that the consideration is not inconsistent with certain obligations. Requires the Department of Central Management Services to prepare and deliver to the General Assembly, no later than September 1, 2007, a report concerning the impact of outsourcing on the State's procurement that identifies contracts in which there was a disclosure that services were provided outside of the United States and a description and value of those services.

House Floor Amendment No. 1
Deletes everything after the enacting clause. Amends the Illinois Procurement Code. Requires that State service contract bidders disclose where contract and subcontract work will be performed and whether work is anticipated to be performed outside the U.S. Permits the chief procurement officer to consider the disclosures and the economic impact on the State in awarding a contract. Provides that if a contract was awarded on the basis of the disclosure that work would be performed domestically, the contractor is in breach if work is not performed domestically unless the chief procurement officer determines that the shift is necessary or contract termination would not be in the best interest of the State. Requires that the Department of Central Management Services report to the General Assembly by September 1, 2007 with specified information concerning contracts awarded subject to these provisions.
