Synopsis As Introduced
Creates the FY2005 Budget Implementation Act. Provides that the purpose of the Act is to make the changes in State programs that are necessary to implement the Governor's FY2005 budget recommendations.

Deletes everything after the enacting clause. Amends the Illinois Income Tax Act. In the definition of "base income" sets forth modifications that must be made to a taxpayer's adjusted gross income concerning interest and intangible expenses that were paid, accrued, or incurred, directly or indirectly, to a foreign person that would be a member of the same unitary business group but for the fact that the foreign persons business activity outside of the United States is 80% or more of that foreign person's business activity. Defines "passive income affiliate" and "foreign person".

 Pension Note (Economic and Fiscal Commission)
 Senate Bill 2210, as amended by House Amendment 1, would not impact any public pension fund or retirement system in Illinois.

 Judicial Note (Admin Office of the Illinois Courts)
 Senate Bill 2210, as amended by House Amendment 1, would neither increase nor decrease the number of judges needed in the State.

 State Debt Impact Note (Economic and Fiscal Commission)
 As amended by HA1, would not affect the level of State indebtedness.

 Housing Affordability Impact Note (Housing Development Authority)
 Senate Bill 2210, as amended by House Amendment 1, will have no effect on constructing, purchasing, owning, or selling a single-family residence.

 Fiscal Note (Department of Revenue)
 As amended by HA1, prevents companies from shifting income to avoid Illinois income tax by denying artificial deductions between affiliated companies. Will increase State revenue by an estimated $40 million.

 Balanced Budget Note (Office of Management and Budget)
 Senate Bill 2210, as amended by House Amendment 1, will have a fiscal impact of approximately $40 million in additional revenues for the State as provided for in the Governor's Recommended Balanced Budget.

 Correctional Note (Dept of Corrections)
 Senate Bill 2210, as amended by House Amendment 1, will have no corrections population or fiscal impact on the Department.

 Home Rule Note (Department of Commerce and Economic Opportunity)
 Senate Bill 2210, as amended by House Amendment 1, does not pre-empt home rule authority.

 State Mandates Fiscal Note (Department of Commerce and Economic Opportunity)
 Senate Bill 2210, as amended by House Amendment 1, does not create a State mandate under the State Mandates Act.
