Synopsis As Introduced
Amends the Freedom of Information Act. Deletes current provisions concerning the award of attorney's fees. Provides that a court shall award reasonable costs, including attorney's fees at trial and on appeal, to a person who substantially prevails in a proceeding against a public body that has failed to comply with the Act.

 State Debt Impact Note (Economic and Fiscal Commission)
 HB 438 would not change the amount of authorization for any type of State-issued or State-supported bond, and, therefore, would not affect the level of State indebtedness.

 Judicial Note (Administrative Office of the Illinois Courts)
 House Bill 438 would neither increase nor decrease the number of judges needed in the State.

 Fiscal Note (Administrative Office of the Illinois Courts)
 House Bill 438 would have no fiscal impact on the judicial branch.
