Replaces everything after the enacting clause. Amends the Open Meetings Act and the Freedom of Information Act. Replaces all references to "Illinois At-Risk Adult Fatality Review Team Advisory Council" with "Illinois Fatality Review Team Advisory Council". Amends the Adult Protective Services Act. Redefines "provider agency" to mean any public or nonprofit agency in a planning and service area "that is selected by the Department or" appointed by the regional administrative agency with prior approval by the Department on Aging to receive and assess reports of alleged or suspected abuse, neglect, or financial exploitation (instead of any public or nonprofit agency in a planning and service area appointed by the regional administrative agency with prior approval by the Department on Aging to receive and assess reports of alleged or suspected abuse, neglect, or financial exploitation). Redefines "regional administrative agency" to mean any public or nonprofit agency in a planning and service area that provides regional oversight and performs functions as set forth in a specified provision under the Act (instead of any public or nonprofit agency in a planning and service area so designated by the Department, provided that the designated Area Agency on Aging shall be designated the regional administrative agency if it so requests). Provides that the Department shall designate an Area Agency on Aging as the regional administrative agency or, in the event the Area Agency on Aging in that planning and service area is deemed by the Department to be unwilling or unable to provide those functions, the Department may serve as the regional administrative agency or designate another qualified entity to serve as the regional administrative agency; any such designation shall be subject to terms set forth by the Department (instead of the Department shall assume the functions of the regional administrative agency for any planning and service area where another agency is not so designated). Defines the term "verified". Removes persons in charge of board and care homes from the list of persons a mandated reporter may notify when making a report of abuse or neglect. Replaces all references to the Department of Public Health's Health Care Worker Registry and instead provides that to protect individuals receiving in-home and community-based services, the Department on Aging shall establish an Adult Protective Service Registry that will be hosted by the Department of Public Health on its website effective January 1, 2015, and, if practicable, shall propose rules for the Registry by January 1, 2015. Provides that the Registry shall identify caregivers against whom a verified and substantiated finding was made of abuse, neglect, or financial exploitation. Provides that the information in the Registry shall be confidential and shall not be deemed a public record. Makes changes and adds language concerning caregivers precluded from providing direct care in a position with the Department on Aging, the Department of Healthcare and Family Services, the Department of Human Services, or the Department of Public Health, or providers thereof; limited access to the Registry; online checks on whether a person has been placed on the Registry; notice to caregiver; notification to employers; caregiver challenges; removal from registry; civil or criminal immunity; access to records; and other matters. Redefines "direct care" to include direct access to a person aged 60 or older or to an adult with disabilities aged 18 through 59 (instead of to an individual). Deletes the terms "privately paid caregiver" and "uncompensated caregiver" and their corresponding definitions. Changes the name of the "Illinois At-Risk Adult Fatality Review Team Advisory Council" to the "Illinois Fatality Review Team Advisory Council". Effective immediately.
