Synopsis As Introduced
Amends the Clerks of Courts Act. Provides that no fee provided for in the circuit clerks' fee provisions may be charged in connection with the filing of any commitment petition or petition for an order authorizing the administration of authorized involuntary treatment in the form of medication under the Mental Health and Developmental Disabilities Code. Effective immediately.

Fiscal Note (Administrative Office of the Illinois Courts)
Based on a review of HB 2319, it has been determined that it would have no fiscal impact on the judicial branch of State governments. HB 2319 would have a fiscal impact on the circuit courts, because it would reduce the amount of fees collected by the circuit clerks. The fiscal impact will be greatest in counties where large mental health facilities are located. In all counties, the fiscal impact will be limited by the fact that a substantial proportion of mental health petitions are filed by State's Attorneys, in which case no fee is charged. A dollar estimate of the fiscal impact of the bill is not possible, because the total number of cases subject to fees cannot be determined and varies from county to county.
