Synopsis As Introduced
Amends provisions of the Illinois Human Rights Act relating to proceedings other than those involving real estate transactions. Provides that the Department of Human Rights shall adopt the Equal Employment Opportunities Commission's determination as its own (instead of at the Department's discretion, the Department may accept the Equal Employment Opportunities Commission's determination as its own or process the charge pursuant to the Act). Effective immediately.

House Committee Amendment No. 1
Provides that, for charges for which the federal and State civil rights protections are identical, the Department of Human Rights shall adopt the Equal Employment Opportunity Commission's determination which shall be deemed the Department's determination.

House Floor Amendment No. 2
Replaces everything after the enacting clause. Amends provisions of the Illinois Human Rights Act relating to proceedings other than those involving real estate transactions. Adds language providing that: for charges alleging violations within the jurisdiction of the Equal Employment Opportunity Commission and the Department of Human Rights and for which the Equal Employment Opportunity Commission does not determine that there is reasonable cause to believe that discrimination occurred, the Department shall adopt the Equal Employment Opportunity Commission's determination which shall be deemed a determination by the Department for all purposes under the Act; and for charges where the Equal Employment Opportunity Commission determines that there is reasonable cause to believe that discrimination occurred, the Department, at its discretion, shall either adopt the Equal Employment Opportunity Commission's determination or process the charge pursuant to the Act. Deletes language providing that: at the Department's discretion, the Department shall either adopt the Equal Employment Opportunity Commission's determination or process the charge pursuant to the Act; and adoption of the Equal Employment Opportunity Commission's determination shall be deemed a determination by the Department for all purposes under the Act. Effective immediately.
